After the charter has been amended as above suggested, and a certified copy of such amendments has been furnished to us, wo shall undertake to outline the proced ure to be taken preliminary to the issue of the proposed bonds. Before the bonds in question can be finally issued, we shall re quire a certificate to the effect that there is no litigation pond ing or threatened which might affect the validity of the bonds. We are advised that there is cer tain litigation pending attacking the validity of the initiative and referendum amendment to the Oregon constitution. These cases are The State v. Standard Oil Company, in the Oregon Supreme Court, and The State v. Pacific States Telephone and Telegraph Company, in the U. S. Supreme Court. There may be other cases of which we have no knowledge: in any event, we shall require information as to the status of these cases before the bonds can be finally approved, because the questions involved in these cases affect the validity of the statute aforesaid which has been adopted under the constitutional provis ions above referred to. As per your request, and sup plementing our letter of August 1, in this connection, we beg to submit herewith suggested forms of the amendments to the Madras charter: 1. We suggest that section 12 of the charter be amended to read as follows: "Section 12. No person shall be qualified to vote at an election under this charter who does not possess the qualifications of a legal voter in the state of Ore gon." 2. We suggest that section 87 of the charter be amended to read as follows: "Section 87. Any and all prop ositions to issue bonds in excess of the sum of twenty-five hun dred dollars, as provided in sec tion 7G hereof, for the purpose of acquiring or constructing and maintaining a system of electric or gas lights, works or water works, or either or both thereof, and for other purposes, shall first be submitted to a vote of the qualified electors of said city at any regular election or at a special election called for that purpose, and such proposition shall receive an affirmative ma jority of all legal votes cast at such electiou on such proposition in order to authorize the issuance of such bonds; provided, howev er, that the amount of such bonds so issued shall not in the aggregate at apy time exceed the sum of $ , and any bonds issued after such limit shall be reached shall be void." 3. Public notice of such election, the object thereof and the amount required for such purpose or purposes shall be giv en by publication, as provided in section nine of this charter."
