The parties to the proceedings were represented by E. Berglund, for Coun cilman Cook, and G. L. Burnler of Prinerilie, for Mr. Stanton. Several witnesses were called and sworn to show different pointsof the election law that. had not been properly complied with, and to carry out plaintiff Cook's contention", which were as follows: 1. "That I believe and have been in formed, that I received a larger num ber of legal votes at the last cif elec tion, for the office of Councilman or Al derman, and that I received a majority of the legal votes for the ofllce above mentioned. 2. -3'h;it the s.ii I C.ty election, held December 6, 1910, as above stated, was an illegal election, and that, as I have been informed and believe, persons voted at sild City election of Madras, Oregon, who were uot legally entitled to vote at said City election."
