FARM LOANS EIGHT PEIl CifilNT PcJR ANNUM NO DELAYS "1 - TWO PER CENT COMMISSION Vermont Loan & Trust Company j See Sanford & McKinney, Madras, Oregon b LAW WHICH REACHED HILLMAN FRAUDS Though the District Attorney and his deputies are unable to discover any law by which the perpetrators of the fake Hillman .townsite proposition can bo prosecuted, the law is on the books, according to the Evening Telegram. Not only is it there, but it is said already to have been used by one lawyer in forcing the promoters' of the goldbrick scheme to refund the coin which s they are alleged fraudulently to have obtained from one of his clients. The law which is said to cover the practices of the wildcat townsiters is printed on page 104 of the Session Laws of 1909, and is entitled "An Act to Prevent False and Misleading Statements ' and Advertising, and Providing a Penalty Therefor." The text '..of the act is as follows: 'Section 1 Any person, who, in a newspiper or olher periodical, or li public advertisement, or bv letter 01 circular, knowingly makes or dissemi nates any statement or aserlion emi renting tin quantity, the quality, the vabie, the price, the method of pro- diu'ini; or manufacture of Ida merchan dise, or the motive or purpose of any sale which is untrue or calculated to mU'ead, shall be deemed guilty of n mpdemeanor, and on conviction t hereof shall he punched by a flue of n it less than $10, nor more than ?50, y imprisonment in me lonniy r b.th .luil not exceed'nc 20 days, or by .mndi fine and Imprisonment." It was under this law that Attorney Julius Silverstone, last Snriner. forced the promoters of the bunco proposition to return $150 which he alleged had been fraudulently procured from his clients. In discussing the affair the lawyer said: ' "The promoters of this fake Hillman .townsite deal obtained $150 by crooked methods from one of my clients. 1 went after them and swung this law on them and they returned the coin. Then is no reason which I can see why the law should not he as available in case of the district attorney as it was in my case. The clause which did the work in the case of my client was the one reading- 'or the motive or purpose of any sale which is untrue or calcu lated to mislead.' "In the advertising literature which they disseminated freely the Hillman townsite people made the positive as sertion that James J. Hill had prom ised to build a depot at Hillman. I saw the Hill people and learned that no promise whatever had been made. The .only agreement was that a depot should J he constructed there tl lounu expedient. , or the business should be found to just-ify.it."
