Developments in railroad construction
and movement of equipment during the
laet few days have pretty effectually
removed the aspect of bluff from the
opt rations of the Oregon Trunk Line,
eays Sunday's Oregonian.
The Work of Porter Bros, has now
reached tho stage when the daily expen
ditures of hioncy, the transporting of
laborers to the scene of operations and
the substantial character of the opera
tions 'undertaken indicate that two rail,
roads instead of one will ultimately
assist in the development of the Central
Oregon empire.
In addition to the evidence of serious
intentions given by Porter Brothers,
Judge Charles H. Qarey, of the law
firm of Carey cfc Kerr, yesterday gave
his pcrEonal assurance that the work
undertaken by the Oregon Trunk Line
constitutes a bona fide investment and
that It Sb the object of tho company to
build a road into Central Oregon.
"Of my own personal knowledge," he
Maid, "I know the identity of the inter
eats that are supplying the fands for the
construction of this railroad. The capi
tal at the disposal of the company is
ample in lact, is practically unlimited.
"In my judgment the construction of
the Oregon Trunk Line will not atop at
its present designated termini. The
plans of the men interested financially
in its construction are for a railroad de
velopment of great proportions.
"Tlio daily expenditures of money by
the Oregon Trunk Lino should convince
the people of Oregon that there is no
element of bluff in the enterprise.
Within the coming week Porter Bros.
will establish ten camps between mile
post 10 and mile post 20. This is in un
contested territory. Complete outfits
for four of these camps leave The Dalles
tonight. With these camps established,
tho Oregon Trunk Line will have 88
miles of the railroad survey covered and
before the end of tho following week
will have CO miles under construction.
"Ten carloads of equipment are now
on the way and tho end of next week
Porter Bros, will have 2000 men at work.
Both the Great Southern railroad and
the Columbia Southern, paralleling the
Deschutes river on the West and on the
East, will l)o uced for shipping in equip
ment. Porter Bros, have leased a ware
house at Slinniko and have acquired
ground for tho erection of another.
INJUNCTION Oil PORTERS' RIGHT OFWAY
Grass Valley, Or., Aug. 4. An injunc
tion was ecrved this morning on Porter
Bros, by tho State Circuit court, order
ing them to desist from work on f even
miles of the Horseshoe Bend district of
the Deschutes canyon. The Deschutes
Railroad Company is ' plaintiff. The
seven mites covered by tho injunction
is the conflict district, where both Por
ter Bros, and Twohy Bros, have been
hastening men for grade work near
Grass Yalloy.
This is the crucial stage of the railroad
struggle. As the couita finally decide
this case, so. will the advantage bp in
choosing strategic positions for grading.
Favorable judgment will mean a eaving
of perhaps hundreds of thousands of
dollars in construction work. The ques
tions to be raised will involve prior
location and to what extent the canyon
law can forco a rival railway line into
costly construction before permitting it
to invade another's right of way. If
this injunction is sustained, tho Porters
would have to take the line of heaviest
work in the Horseshoe Bend district,
but na other part of the survey is called
into question hy this case.
Peace reigns. There is na evidence of
purpose to. resist or evade court orders.
Both sides were yesterday hauling over
the contested supply road down to the
canyon. The Porters received 60 re
cruits yesterday, and the Twohys ai out
50. These were sent to the Cove dis
trict near Shuniko, which is now the
center of keenest activi ies Court com
plications are expected there soon.
Both parties are opening construction
camps ai various points along the river
beyond the conflict zones. Automobiles
bearing attorneys and managers fly from
one place to another, with n serious busi
ness air. Despite' courts and coups,
both parties continue pressing opera
tion?, and insist that they will build u
line to Central Oregon.

jtfot to be outdone, Harrnaan's legal
representatives at once filed condemna
tion proceedings against Porter Bros. In4
an effort to forco an entranco to the dis
puted terrritory through the property,
of their rivals.
Arguments in the injunction, enact oc
cupied two days in tho Circuit Court
here. A night session, was also held to,
expedite the hearing There was along,
array of legal talent or both the cpn,-.
testing parties.
Tho records in tho case were volum-i
inous, there being about 75 or 80 pages,

the pleadings in tho case, which wero.
also, quite lengthy. T,h,e arguments,
lasted until II o'clock last night, and
were taken up again this morning at
0 o'clock and completed at about H
o'clock today, when Judge Bntler took, '
the matter under advisement, and ren
dered his decision after 0 o'clock to-.
night.
The evidenoe showed that the plain
tiffs secured certain rights to go over
these certain lands with their wagons
and outfits, and on the strength of these
rights expended $8000 in constiucting a
grade down the canyon of the Deschutes
to the railroad right of way. But no
deeds were taken by tho plaintiffs from,
the land-owners, nor any agreements in
writing. Porter Bros, saw tho opportun
nity and purchased from the land-own-erf
the land over which this road ran,
and immediately upon securing passes
sion under these contracts stopped tho
Deschutes Railroad Company fram,
sending in supplies over the road.
While the temporary injunction was
in force, the Deschutes Railioad Com.,
pany had been sending in about 1Q to ii
wagonloads of provisions each day, am)
now has a sufficient supply to last for ftl
least two months, there now being 36
men employed at this point on the river.
RIVALS WARRING IN BIG COVE
Bhaniko, Or., Aug. C. Trespass warn
ings have been posted on the Dean
ranch, 20 miles from this place hy the
Harriman railroad engineers ami the
situation is practically the same aa that j
which exists at the Gnrta ranch, near
Grass Valley, with the competing rail
roads occupying reversed positions.
Tho Dean ranch controls access to the
work to be done along a line of bluffs at
White Horse rapids. This ranch was
acquired by James B. Eddy, Bpecial
right-of-way agent for the O. R A N,
but tho deed Was made out to Mr. Eddy's
married daughter, and tho deal was
