The bill of complaint is a long one, and goes back to the original terms of the grant made in 1870. By those terms the grantee company was required to sell the lands to actual settlers at not to exceed $2.50 per acre, excepting such j lands as are necessary for depots, sta tions, trackage and other needful pur posed. These terms the company has never complied with, although it has sold about half of the original grant at much higher prices to the big timber companies operating in this state.
