Frank Osborn and his mother, Mrs.
George Osbom, left last Saturday for
Cortland, in response to n message noti
fying them of the serious illness of Mrs.
Charles Wilson, who was formerly
Maude Osborn. The telegram stated
tljat Mrs. Wilson was in a very critical
condition. On reaching Shaniko they
received word that Mas. Wilson was very
much improved and out of danger and
that it would be unnecessary -to mnke the
hard trip through by stage to The Dalles.
They returned home Monday evening.
About two hundred letters reached here

Ernest M. Smith's linal five
year proof upon his homestead
was rejected by the local land
ofiico, as a five-year proof, but
he was permitted to offer the
proof as a commutation proof,
which was accepted. The rea
son his live-year proof was re
jected was because he offered
his proof before the expiration
of the live years, as it is com
puted by the land office. The
error came about in this man
ner: When residence is estab
lished upon a homestead entry
within the first six months the
residence runs from the
date of the entry; but, if the
eutryman does not go upon his
homestead to establish resi
dence within the -first six
months, then the lime of his
residence begins to run when
he actually goes upon the land.
'1 he first six months does not
count as residence unless resi
dence is established within
that tune. Tina was tne case
in the entry of Mr. Smith. For
unavoidable reasons he did not
establish his residence upon
his homestead during the first
six months, and he got no
credit for that period. His
residence was computed from
the date upon which he first
established residenco, shortly
after the expiration of the first
six months, and five years had
not elapsed before the date of
proof. This explanation iB
made for tho benefit of those
who heard the story that Mr.
Smith's five-year proof was re
jected, and that he was forced
to make a cash entry. Tho fact
of the matter is that his proof
of residence waB good, but be
cause of his failure to go on the
land in the first six months ho
lost credit for that time, and his
live years of residence had .not
fully run. Mr. .Smith had
made -arrangements to move,
and .rather than alter these
plans and oome back and live
the remaining few months to
make out his five years resi
dence, ho decided to majce a
cash entry of the land. The
decision in his uaeo has no
bearing on the case of any
eutryman who went on his Inn'c)
within the Jirst six months.
