    FAMOUS TREASURE
CASE SETTLED
Medford, Or., March 10. A surprising compromise
that settled the famous "titi-can" case of Jacksou county
was reached at a quiet conference between the principals
and their attorneys here yesterday, Roberts and O'Neil
agreeing to pay to C. P. and W. O. Danielson $6,000 with
accrued costs and interest, amounting in all to $10,000.
Thus ends the noted treasure battle, which originated in
the finding of a can of gold containing 57,000 in an out
house belonging to Roberts and O'Neil, when the Donald
sons, plaintiff's, were still young.
When they found the mouey, Roberts ami O'Neil,
who had employed them to clean the outhouse, claimed it
on the ground of owning the building. The boys claimed
it on the ground that it was treasure, and consequently
finders money. When they reached maturity they began
suit. At first they were
Supreme Court were noti suited agaiu. The case was sub
mitted to a jury in the circuit court last fall, and the jury
disagreed. It was continued without result at- Ihe Decern
ber term.
While the compromise was unexpected, it was ap
parent that a jury could probably never be gotten together
to agree on a decision, and indefinite lawiug looked proba
ble. Failing health in one of the litigauts was another
factor in bringing about a settlement.
