.1 II ELEBRATED CRIMINAL CASE. CONTINUED FROM F1KST PAGU. 1 ii a? Sr i if communicated Lis suspicions to the at tending physician handed the bottle to Dr. Carter that its contents might bo analyzed; and the analysis showed it contained nearly or quite a grain of ar Benic About the same time a discovery was made by Alice Yapp, one of the nurses, which tended to deepen suspi cion and incriminate the erring wife. Miss Yapp found several fly-papers soaking in water in a basin covered with a towl and a dish. Evidently some ono was preparing a solution of arsenic, for each one of the same kind of fly-papers as those in soak was found, on analysis, to contain more than two grains of arse nate of potash and arsenic. It was afterwards ascertained that Mrs. .May brick had purchased one dozen of these s fly-papers at one drug store and two at another. ,Mr. Maybrick, as already stated, died on the 11th of May. The suspicion resting on Mrs. Maybrick justified the attending physicians in refusing to give ! a certificate stating the cause of death. 'Mrs. Maybrick was arrested and a post- j mortem ordered. Post-mortem exami nation revealed evidences of irritant poison. Arsenic was found by analysis in the liver, kidneys and the contents of the intestines, but not in the stomach MBS. MAYBRICK CONVICTED OF MCRDER. Mrs. Maybrick was charged with the wilful murder of her husband by the ad ministration of arsenic Her trial which commenced on the Slst of July, 1SS9, lasted seven days, ending on the 7th of August. Mrs. Maybrick had the advantage of be ingefefended by some of the ablest law yersIn Great Britain including Sir Charles Russell, who afterwards became Lord Chief Justice. The Judge before whom the case was tried, Mr. Justice Stephen, enjoyed the reputation of be ing one of the ablest and most fair minded judges that ever sat on the Eng lish bench. Mrs. .Maybrick accounted for her pos session of the fly-papers by stating that she had nsed them for a cosmetic wash for the complexion ; that she had used sucha wash in America with her moth er's consent arid that certain friends in Germany used a solution made from fly papers for a similar purpose. The Judge pointed out, however, that these statements were not supported by testi mony as thev ought to have been and might have been. "The moral, as well as the circum stantial, evidence was strong, and to gether with the positive evidence of the discovery of arsenic in the body, as well as in the food and 'medicine, the pur chase of arsenic by the accused and the short, sadden illness corresponding in its symptoms with those of arsenical poisoning, convinced the jury A Mrs. Maybrick's guilt." After an absence of 40 minutes the jury returned with a verdict of ".guilty." Whereupon the Judge donned the black cap and pronounced the sentence of death upon the unhappy woman. The Home Secretary, however, remit ted the death sentence to imprisonment for life, on the ground, as it would seem, that legally the scientific evidence did not wholly exclude a doubt whether death was in fact caused bv the admin istration of arsenic, while, at the same time, no doubt was entertained as to the administration of arsenic with in tent to kill. Xow that Mrs. Maybrick is free and in her native land, how will she be received? Idaho Magazine. An exceptionally important decision has been rendered by the general land office in a case coining before it on ap peal from the local federal land office in .Montana, in wiiieu the leading issue joined a cross cut of the rival claims of persons to a piece of land iu that state, one claiming it under an agricultural entry, the other under a mining location. The Montana local office, instead of ad hering to the old, established rule, that a mining claimant must show that the land produced mineral in par quantities-! as a present fact in a word, that he must have a paying mine on the claim decided that the mineral contestant need only show that the land contains mineral in sufficient qnantitr and of such value as to justify a reasonable and competent person in expending time and money in exploring ana de veloping it where the prospector is actually woiking the ground. This liberal rnling of the local land of- nce was unqualifiedly sustained by the general land office. "Many of our best paying mines." says the decision, "at some period of their existence, would not have been able to withstand a con test by an agricultural claimant under a strict construction of the rule."
