THE LAW OF 1S90.
The Sherman Act and the Purchase
of Silver Bullion.
1SS9 W). Chapter DCCVII1. An act
directing the purchase of silver bullion
and the usue of treasury notes thoreon,
and for other purposes.
Be it enacted. That the secretary of
the treasury is hereby directed to pur
chase, from time to time, silver bullion
to the aggregate amount of -1,500,000
ounces, cr so much thereof as may bo
offered, iu each month, at the market
price thereof, not exceeding $1 for 371
25-1G0 grains of pure silver, and to issue
in payment for such purchase of silver
bullion treasury notes of the United
States, to be prtpared by the eecretary
oi the treasury, in such form and of each
denominations, not less than $1, nor
more than $1000, as he may presciibe,
and a sum sufficient to carry into effect
the provision! cf this act is hereby ap
propriated out of any money in t'ae
treasury not otherwise appropriated.
Sec. 2. That the treasury notes issued
m accordance with the provisions of this
act shall be redeemablo on demand, in
coin, at the treasury of the United
States, and when so redeemed may be
reissued, but no greater or less amount
of such notes shall be outstanding at
any time than the cost of the silver
bullion and the standard silver dollars
coined therefrom then held in the
treasury purchased by such notes;
and such treasury cotes shall be a
legal tender in payment of all debts,
public and private, except where other
wise expressly stipulated in the contract,
and shall be receivable" for customs,
taxes and all public dues, and when re
ceived may be reissued ; and such notes,
whea held by any national banking as
sociation, may be counted as a part of its
legal reserve. That upon demand of the
holder of any of the treasury notes
herein provided for, the secretary of the
treasury shall, under such regulations
33 hs may prescribe, redeem each notes
in gold or silver coin, at his discretion,
it being the established policv of the
United States to maintain the two met
als on a parity with each other upon the
present legal ratio, or such ratio as may
be provided by law.
Sec. 0. That the secretary of the
treasury shall each month coin 2,030,000
ounces of the silver bullion purchased
under the provisions of this act into
standard silver dollars, until the 1st day
of July, 1391, and after that time he
shall coin of the silver bullion purchased
under the provisions o! this act as may
be necessary to provide for the redemp
tion of the treasury notes herein pro
vide! for, and any gain or seigniorage
arising from such coinage shall be ac
counted for and paid into the treasury,
Sec 4. That the silver bullion pur
chased under the provisions of this act
shail be subject to the requirements of
existing law and the regulations of the
mint service governing the methods of
determining the amount of pure Eilver
contained, and the amount of charges
and deductions, if any, to be made,
Sec. 5. That eo much of the set cf
February 23, 1S7S, entitled, "An act to
authorize the coinage of the standard
silver dollar and to restore its legal ten
der character," as requires the monthly
purchase and coinage of the same into
silver dollars of not lesj than $2,000,000
nor more than $4,000,000 worth of silver
bullion, is hereby repealed.
Sec. G, That upon the passage of Ibis
act the balances standing with the
treasury of the United Stales to the
respective credits nf national banks fo
deposits made to redeem the circulating
notes of such banks, and all deposits
thereafter received for like put pose,
shall be covered into the treasury as a
miscellaneous receipt, and the treasurer
of the United States shall redeem from
the general cash in the treasury the cir
dilating notes of said banks, which may
come into his possession, subject to re
demption, and upon the certificate of
the controller of the currency that sucl:
notes have teen received by him, and
that they have been destroyed, and
that no new notes will be issued in
their place, reimburcements of
their amount shall be made to the
treasurer, under ecch regulations as
the Eecretary cf the treasury may pre

provisions of this act shall not apply to
