It is a curious fact that most of tae crimes of violence tbe burglaries, tbe murders and surh Hk bare been com mitted by men vko bad i erred one or two terms in tbe penitentiary. Tbe trial of tbe Mendocino outlaws bas de veloped tbe act tbat all of tbem were ex-convicts, and two were condemned morderers. One bad been pardcnd out by Governor Irwin on condition tbat be left tbe State, which, of couise, he had no intention of doing when be made tbe promise. All were well known to tbe police generally, and really and truly speaking, were known for a long time to be living on tbe proceeds, of theft, al though no direct evidence connecting them with anv robberr could be ob tained. These being the facts, it becomes a question for society to determine whether such men, who are known to be preying ujxjn ths industrious commun ity, and corrupting all with whom tbey a&sociate, should be jMrsritted to ba at large, until tie perpetration of some frightful crime renders it absolutely necessary to arrest them. They have no visible means of subsistence, yet they arc known to lire well, and gen erally to be plentifully provided with money, and it would seem as though there should be no scruple as to their arrest under such circumttanoes. It it also apparent that the pardoning power in Bach cases should be very sparingly exercised, if at alL The graduates in crime should not be permitted to extend tbe circle of their acquaintances any further than, is absolutely necessary to further the ends of justice. A man s Erst onenso may be reasonablv con doned, if any signs of reform are shown, but theso second and third term offenders should be dealt with very rigorously. San Jose Mercury.
