Late Hidings Under The
Homestead Laws.
The act of settlement must bd noto
rious and lignificant of. a purpuse.
Th mere act of locking the door of
a purchased houe is not settlement.
Settlement is a personal act and can
date only from the tiru the party went
upon the land. Purchase of prior ioi
provemrnts does not transfer vender's
datt! cf settlement.
Work by a party wlto'is hired to dig
a ditch cannot be claimed as au act of
settlement.
Credit is not allowed for settlement
on land not subjret to entry.
A subsequent settler who enter un
enclosed land" without force can ac
quire title.
Acts of settlement performed while
the land is emhracedin a homestead
entry give a clatmunt no leal status.
After cancellation of the entry the
rights of two pre-emptor8 must b de
termined by their eettWient and not
by their residence; the 6rst bona fide
settler takrs the Uud in dispute if foi
lowod within a reasonable lias by
his residence thereon.
A settlement is an appropriation of
land, anil a subst quest intry is tub
j"Ct to the settler'a compliance with
l. Thi entry appropriates it
against the world, except the prior
settler. Th abortion of th settlor's
claim initiates a context. The burden
and ei enst of proof is upon the cn
trytnan. Tha settler's ap lication to
transmute must be rereived and the
entryman gin an opportunity ti
show cause why it should not ba per
ruined.
A ioinpstead entry is an appropria
tton of the land involved, taking ef
feet from the date of settlement, and
after that date a pre emptor could
acquire no rights to th land excpt on
cancellation of the homestead entry.
In case of unsurreved lands, where
a party notifies a subsequent asttlrr ta
keep lit j slock away from the land
cov-red br the prior party's iaiprova
menta, it is sufficient notice that he
claims tha subdivision U-n which his
improemnts should appear to be
when survey wai matin.
A party purchasing from the "Unit
etl States a tract on which are aban
doned iinprovempn'a may claim the
improvements found upon it at th
date of purchase.
While a homestuad entry remains
uncancelled, anather entry of any kind
cannot be allowed.
An entry of record valid on its face
sxcppts a tract nf land from a sub-e
queritW, grant or sale, until a fr
feiture is declared.
A mere occupint of public land has
no right thereto.
J-Miit entry by pre-emption and
homestead claimants may be allowed
Where two homesteader settled be
fore survey on the same 40 aero tract,
joint ca.h entry may be made.
The practice of allowing partips
making a homestead or timber culture
entry credit for the fee and commiss
ions aid by them on a canceled prior
entry is discontinued.
A honiestead'application, erroneous
in form, afterward corrected, should
take effect from tlu date when 6rst re
ceived at the local land office.
The homestead entry of a tract not
legally subject tfisreto is void, and
mus be regarded as never wade. The
ptrty may thereafter apply to make a
legal entry.
A neeond homestead entry n ill not
be refused on account of carelessness
in selecting land upon which a prior
stller is actually maiding.
Lnd oififlacd during the late
wti.ter and early rpring months, but
tilla'nl afitr the 1st of June, is
not "iiwaRip and overflowed land" with
in the meanin; ol the law.
Fiiinys ami mtries cannot date back
of day when reserved land i ordered
restored to the public domain. Bat
no m9re de fwcto reservation or appro
priation can effect the right of quali
fied claimants.
Homestead claimants on timber
lnds are liable to prosecution for re
moving pd se'ling timber bsfore final
proof is roane.
Where tha facts show goad faith in
the pott'ement and cultivation of (he
land by tha homestnader, tlin cutting
and galling ef the timber upon bis land
need not be reported by special agents
Lnd that corners on another tract
does nut "adjoin" it
inera are itriks and rumors of
strikes all over the East; riots and
Chinese excitements throughout the
West. Nobody satisfied with the
bttuation either in political or businves
circles. The President is too demo
cratic to pleacs the republicans and too
republican to please, tbe democrats.
The party went into power with u
treat parade of promises, not one of
which has been realized. No improve
tnent in business; no increase in prices,
no division of the treasury surplus, no
reduction in taxation, virtually no re
duction in the national debt, no in
crease in our foreign commerce, no ex
tension cf our influDiicd among the
states of South America whereby ad
ditional fields for trade would ba
opened, no needed legitdatiou passed;
but all along the line of its v tar's ex
perience lies fragments of broken prom
i.e and results which give the lis to
the pledges and denial to the hopes
under which the party won its scratch
of a victory. And already the hand
writing is being traced upou the wall,
and the reflection of 1888 is anything
but pleasing to the ardent worshiper tt
the democratic shiine.
-Several defemlss Chinamen have
b-en driven from their places of labor
in the vicinity of Portland, in the ret;
ular kuklux stylo. Some of the sus
pected night raiders languisbeth in
j.il- and the Chinese six companies
offer a reward of 100 per head for the
conviction of ttmir persecutors. It is
certninly most desirable that the Chi
nese ba gotten rid of but it is of
creater iniportanco that none bat legal
means be employed. The anti coolie
leagues have not shown themselves
cipihlp. of grappling with the situa
tion with any degree of success. In
deed the leading membership of the
leagues forms one of, tha greatest im
pedlruonts to a )"acful solution of tho
question, as peaieable and lawabiding
people who are in full sympathy with
the idea of getting rid of the Chi
nese will not be known as associates
of such character as are employed in
kukluxing the little yellow man.
At the battle of Sliiloh, one of the
fe'lowawho found it uiicnuifor'sble at
the front, decided to withdraw, and
for an excuse, gathered up a wounded
rann, slung him over his shoulder and
started back. Oa the way a cannon
shot came along and took I'ffliu bur

surgeon, who asked wlmre he was a

hospital to get Im wound dieted"
What's thn use taking him back He's

glanced over his shoulder, and, for the
state of affaiis, exclaimed: "The

Josh Billings was askeil: "How
fast does sound travel" His idea is
that it depends a good deal upon the
noise you are talking about. "The
sound of a dinner horn, for instance,
travels half a mile in a second; while
an invitation tew get up in the morn
ing I have known to ba three-quarters

and then not hev strength enuff left to

Doing nothing for others is the un
doing cf one's self. Wo must be pur
posely kind and' generous or we miss
'he best part of exutance. The heart
that goes out of itself gets largo and
ful1 or joy. This it the great secret of
tha inner life. We do ourselves the
most good doing something for others.
"And how does Charlie like going
to school!" kindly inquired a good
man of a six year eld boy. "I like
goin' well enough," rep'ied the embryo
ctateaman, ingenuously; "but I don't
like stayin' after I get there."

Comments.
Tf we are" to judge 'by tlis current
comment of its leading and Influential
journal we can uot conclude that the
Deiiiocraiic administration has beca
th success that the party promiird it
should be. Over one fourth oi its
lease of power expired'and there is not
a ingle interest in the whole nation
ihat is in as good a khpn as it was na
year before tho D-imecracy took tho
helm. What is true of the Pacific:
coat is truH of all other portions of tho
nation. Our products have decreased
in price without a corresponding de
cline in article of consumptions, which
vu import from other countries. It is
true that there has been a general de
cline all along tho line but as it al
most always htppeiiri in times of de

Bosides titesa Lutj luiicrruutjf the m -

in anv way improve the condition of
the country, which finds expression in
such criticisms as the following from
their great journals:
"Cincinnati Enquirer:" Mr. Cleve

which makes anything that can now
be said in critieisui of them justifiable.
"Ilari.oi's Weekly," in taking stuck
of the first year of this administration
which it helped into power, expresses
the general conviction in the reutenca:
"It i: doubtful :f there is any general
