Tlio Stale Attorney. Mr. Mallory, wns agisted In tlio prosecution by Col. Kcls.iy. Quite an array of counsel appeared for the defcudent, consisting of Messrs. Moshcr, Heed, Bergen, Powell, Poulhllt and Foster. Mr. Mallory brlifly opened the case on be liatf ol the State, and Captain M oilier, In n short and appropriate speed., presented the grounds of tli defense. At 4 o'clock tlio evidence was closed, both parties resting upon the ivldencc deduced by the Slate. , Mr. Mallory then in n pertinent address to the Jury, summed up the cvldeneo fur tlio proscit tlon. He was followed by Mr. Powell for the tltftnsc, who had the Ihor but a few minutes . before tha Court adjourned till the next morn lag. Thursday morning, after Mr. Dowcll had Unified. Mr. Heed closed tha argument on tlio part of tha defense. Col. Kclsny, in n ply. closed the argument on the port of I lie Slate, Ilutlng received the charge of tha Court, tha jury were out about Ihrco hours, and returned verdict of not guilty.
