Bradley Francis Durphy ha« been
sentenced to a term of eight months
In the Multnomah county jail, and
also to pay all costs, by Judge Sears,
for polygamy.
His attorneys were
surprised when the Judgment of tbe
court was proriounced. They had ex
pected that a fine would be imposed,
which, If not too large, they were
prepared to pay wlthoat appealing
the case to the supreme court. An
appeal will be taken. Durphy, who Is
not anxious to spend any time in jail,
and will fight against imprisonment
as long as there is any hope left him,
has been released on bonds. An
attempt wa* made by counsel repre
senting Durphy to have District At
torney Chamberlain ask tbe court» for
a fine without imprisonment: but the
latter refused to agree to it. When
the case was called Judge 8eara asked
if there was anything tube said in
favor of Durphy. To this F. P. Mays
said be wished to call the attention
of tiie court to the statute of Illinois,
by which after a man and a wife
have been separated five years they
are free to marry again. He con
cluded by saying that If Durphy was
guilty It was merely on a technical
point.
Durphy took the sentence
