vised Statutes, and the amendments
thereto, shall be entitled to the bene­
fits of the homestead laws as though
such former entry bad not been made;
but commutation under section 2303,
Revised Statutes, shall not be allowed
of an entry made under this section.
Section 3 provides that any person,
who, prior to the passage of this act,
has made a homestead entry, but
from any cause has lost or forfeited
the same, shall be entitled to the
benefits of the homestead laws as
though such former entry had not
been made. Therefore they will no»
hereafter reject a homestead applica­
tion on the ground that the applicant
can not take the prescribed oath that
he has not previously made such an
entry, or because lie has perfected
title under section 2301, Revised
Statutes, to land entered under the
homestead law; but he will lie re­
quired to show by affidavit designat­
ing the entry formerly made by de­
scription of the land, number and
date of entry, or other sufficient data,
to identify the same on the records of
this office, and that it was forfeited
or commuted, as the ease may be, pri­
