In respun ling to the toast jn«t pro- ¡g>aed it may be suggested that tbe pio neers ol Oregon, and especially of soutli- etn Oregon, tnet with many diffictiifieH in the administration of justice, as well as in other affairs, owing to the peculiar Htatus of the country at the time of its early settlement. Prior to 1852 this ¡»art of the stale was uninhabited, except bv savage Indians. In 1851 and 1852 rich gold mines were discovered in Jackson ville and vicinity, which caused a large rmniber of people, consisting of miners, packers, traders and gamblers, to assem ble at that point. At that lime there was no county organization in this end of the state, consequently there were no courts in existence for the redress of public u rungs or civil injuries. Here was a section of country in which a tiiousaud or fifteen hundred people had assembled, who were engaged in locat ing mining and land claims and in other exciting purMDts connected therewith, without law, or officers to enforce its in fraction In this state of affairs a man by the name of Brown, without sufficient provo cation, shut and killed a miner. Here was a serious emergency to be met—hu man life ha«i been wrongfully taken, and no officer or court in existence with authority to arreBt atnl try the murderer. ’ .... .............. .. A court was immediately organized and an officer appointed with authority to a»rest ami try the said Brown lor the alleged murder. One attorney was a|>- pomted to prosecute the case and kn ottier to defend. A jury of twelve men having been selected, the case was tried hi accordancu with the ordinary forms of law applicable to such cases. After hearing the evidence ior ami against the lefendant and the argument of counsel, the def« ndant was found guilty of mur der in th«* tiist degree, and was sen tenc'd ami hung in pursuance of said verdict. counsel upon a legal question, Mi. Ja coba asserting the law to be one way and Kenney another. In the discussion of the proposition Mr. Jacobs, becoming a little animated, inadvertently remarked that he would l>et that the law was as he had stated it to t»e, to which Mr. Kenney replied, as quick as thought, by asking him how much he would bet on the proposition, at tbe same time throwing upon the judge’s table three fifty-dollar slugs, calling U|»on Mr. Ja<*obs to hack hi* judgment with that amount. Jacobs being an emigrant who had just crossed the plains, was broke and could not for tify bis tKjsition in that manner. The authority to which he referred living against him, the point was decided ad versely to him. The supreme court re versed the judgment of tiie alcalde court and restored the mining claim to Springer. I have presented ymi with a short his tory of these two cases to enable you to belter understand how justice was ad ministered in tbe early days of Oregon. One of them was a criminal case of the highest grade, in which tiie life of tiie offender was involved, and the other was a civil action involving a mining claim of tiie probable value of $4.000 or $5,(XX). Tiie time consumed in the creation and organization of tiie courts and in tiie trial and disjKjsition of these cases did not exceed eight or ten «lavs. It siiows tiiat justice was administered in those «lays promptly and with cer tainty, and that the early pioneers of this country were equal to any emergency. THE SETTLERS MUST GO. Washington, Sept. 10.—Secretary N q - ule to-day decided a case that has been long ¡»ending, aud which is very impor tant to many people in Oregon. Several months ago in these columns was given a histoiy of the struggle of swamp lands in the Lakeview district, mostly located in or adjacent to lakes Harney and Mal heur. These lands were given to the state under the swamp-land act and sold to different purchasers who claimed them. Notwithstanding this, settlers went uj»un the lands ami endeavored to prove that they were not swamp lands. The purchasers were subjected to a great deal ot in convenience, the property de stroyed ami the claimants proved them selves generally reckless. When ths claims weie made special agentB were sent out. and five different agents at three different tunes went out aud re- I»orted that the Lends were swamps. The contests, however, had been initia ted, aud having been deuied, the claim ants appealed, asking (or a hearing and trial of «*och separate tract. This Secretary Noble refuses to grant. He says both tbe interior department and state department have agree«I upon what was swamp, and ail tiie «¡»ecial agents' reports have agreed ii|»ou the same ba sis, aud therefore the hearings must ba tienied. Of the original lists there were 97,641 acres in the Lakeview district winch were certified - ---- and — approved r.v««rx. • in — 18>2.
