The following is a portion of an e«litori-
al of the San Fran«-isco CAronmic on the
late «leciaion of Judge M. 1*. Ik-ady, on
the fourth clause in the Inter State Com­
merce bill. If the Ckrunich bad said
that Deady in “his zeal to btiilti up Port­

would have been absolutely correct:
“The first authoritative construction uf
the inter-htate commerce act comes from
the opinion remlere«! by Judge Dea<!y,
United States «listrict judgefor Oregon,
sitting as circuit judge, in which he <h-
ciiles that under section 4 of that act,
which proviile* against charging !«•»» fot
a long than a short haul, the fact that
there is competition in the carriage of
persons or property to or from a particu­
lar place is a circumstance that justifies
a common carrier in charging less for a
long haul to an<l (iioni said placethan a
short one included therein. This is an
admirable illustration of w hat is correct­
ly called justice made law.
Judge
Deadv has not decided this case upon
the letter of the act of Congress, but up­
on his own |ieculiar idea of the effe«-t of
law iiisin railroaiis and their business,
in other words, he has straim-'l a ]>oint
to express his disapprobation of tlx- ¡««1-
iey of tlx- law in question with which he
nor anv other judge has any isMtsible
concern. That this decision i» luu«ed ii|r
on w hat Judge Deady considers the gen­
eral principles of equity rather than up­
on the act itself is rfiade manifest in
that part of the opinion where the leain-

ize«! to make less rates for a long than
for a short haul whenever, by reason of

der his decision even that would war­

haul sect ion. Judge Deady, ill his zeal

southern Oregon. Dr. Thoma» T. Caba-
niss wa» b««rn in Bottetoirrt county, Vir­
ginia, ami came to California in 1S49, set­
tling in Shasta, then called Railing’s
Springs. He was an average, plivaician
ami a good surgeon, and soon fell into
lucrative practii-e. He reinov«-«! to Yre­
ka just about the time that Siskiyou
county was set ot! from Shasta, and lived
there till ls.V>, when he niarrie«! a daugh­
ter of Col. Tlios. Gray, of San Erancisco,
who survives him with eight out of nine
children. Th«« doctor niov<*d to Jack­
sonville in this State, but only stayed a
year and went back to Siskiyou. He
was electe«! to the legislature in lkoS am!

had a quarrel with David 1). Colton,then
Sheriff of Siskiyou county ami afterward

tral I’acific railway system and the Hunt­
