The Independent State Convention
met Tuesday, and after much travoil
finally found a person who would ac
cept the nomination for Congress in
the person of Elder G. M. Whitney, of
Lane county, a blatant Campbellite
preacher. Whitney is a strong tem
perance advocate, and his nomination
by the Independents may be construed
into a bid for the endorsement of the
Temperance Convention.
Tax Law Declslou.
The last Legislature passed an
amendment to the assessment law, ex
empting only one thousand dollars of
indebtedness to each tax payer. The
constitutionality of this law was tested
in the action of W. P. Doland vs. O. M.
Barnard, Assessor of Multnomah coun
ty, in the Multnomah Circuit Court.
This case was a proceeding for a writ
of mandamus to compel the Assessor
to deduct from the aggregate value of
property the full amount of indebted
ness within tlie State. Mr. Doland
gained his suit, and the law was de
clared unconstitutional, and therefore
void. The Supreme Court affirmed
this decision, on an appeal from that
county. The Salem Mercury thus
refers to the matter :

assessors in the several counties to deduct
the full amount of indebtedness within the
State from the aggregate valuation of the
property of each individual, whenever such
indebtedness is properly enumerated and
