trestle approach :1029 feet long, from
the receiving wharf to the root of the
north Jetty, and the construction of
4S:t feet of the north jetty.
"The expenditures during the fiscal
year ending June 30, 1898, resulted, In
extending the north jetty for a distance
of 428 feet, giving It a total length of
111 feet.
"Nothing has been done toward the
construction of the south jetty, the
project providing that the uorth jetty
shall tie constructed tlrst.
"The depth on the bar has not been
materially Increased since the con.
struotion of the uoith jetty was begun,
and no permanent improvement In

Horner, this morning Hied a motion to
dismiss Hie case, whereupon Plaintiff
Horner, and Ceo Weber of this oily,
Whom II la supposed is mixed up in
the affair, lelt the court room Horner
left an order with Eli Bangs for a team
to meet li i in ( the corner of Seventh
and Olive streets, I lit fealinglo wait

started, but waaoveilakeii near Hud-
dleaton'i and brought bank by Bharifl
Withers.
The officers, who had possession of
the note v surdity, concluded it was a
forgeiy and were prepared lo act.
Bench warrants were at once issued
for Horner and Weber, ami Judge
Hull. ml was detained, being stopped
at the 8 P depot, awaiting the arrival
of (he 10:60 local, Constable 1 Iceman
and Chief of Police Stiles left In pHr
suit of Horner, finding him at Irving,
6 miles below town and returned at i
P in.
The note which Is the cause of the
trouble was Issued bearing date of
Jan 5, IS9'.', is nihdo payable to "Alice
EdmundSOU," and signed by "J H
Coleman." Tbe amount of tbe note is
S-VrOO, and in August 18, 1884, beurs a
creditor $100. The note is transferred
to Eli Horner, who claims ho pur
chased il from Alice E Imundsou.
Younir W elier, who Is a resldeut of
this city, and a barber by profession,

nation and the same was set for 4
o'clock this afternoon. He was nut
confined in the meantime, but was
placed in the custody ol Deputy Hherifl'
Howard Mulkey.

note was not in his possession, but

interest iu the note, having gone lu
with Horner to buy it.
The olllcials have for some time been
working on the case and were virtually
prepared fur the sudden termination of
of tbe case as it occurred this morning,
yet did not anticipate it coming so
oon. The fortunate capture of Horner
mid his attempted escape, however
only adds to the theory of the olllcials,
win deserve credit for the work done.

forgery in the complaint. A few errors
