this time.
In the outset tlie city does not tiow
and never did own an inch of tbe pub
lic square surrounded by the hundred
foot street, which all are familiar with,
neither does the city, nor did she at
any time, claim title or ownership of
any part of said square. The city does
not own, neither does it claim a single
rlht in, to, or upon said grounds, save
tlue expressly granted to her years
ago by the county court, and thove im
pos d by the laws of Oregou. Those
rights aud duties are these:
First, to occupy said grouuds with
theciiy hall aud city jail at the will of
the couuty, and no lunger, after sixty
days' notice given to vacate. Be. ond
an aet of tbe legislative assembly en
joins upon the city tbe duty to see that
tbe streets running through said
square along with othe1 streets In tbe
city are kept In good repair. The above
is the full extent of tbe privile s and

never seriously questioned until as
eastern abstracter came In and succeed
ed in raising a tempest In a tea pot,
and up to this time has made wore
money out of tbe matter than all
others combined, aud rumor baa it
that he would like to make some more.
While he lias succeeded in getting tbe
cats and the monkeys to quarreling lie
has gotten tbe cheese.
A contention between tbe city and
county Is purely imaginary. There
is nothing to contend about, and tbe
only result of a couhst betweeu tbe
two would be to fee lawyers aud ofll
cers, aud neither party to tbe litiga
tion would be benefited. I am told
by old settlers (I do not know of my
own knowledge) that tbe streets
through the public square had been
platted before, tlie deeds from Mulligan
and .Skinner were executed, and after
the execution of the deeds the couuty
court lu the exercise of its own dis
cretiou and upon its own motion open
ed up tbe streets ruunlng east and
west, and iionh and south through
the square. Tills was done twenty
eight years ago. Oue of the donors
(Mulligan) aud the heirs of tbe other
have acquiesced iu the action of tbe
couuty court all these years, hence th
statute of limitations has run against
every oue of them aud they are abso
lutely barred from asserting any claim.

there Is no reversionary clause in either
of said deeds, which of course pre
cludes a retaking of said square, or
any part thereof, by either of the don
ors or their heirs.
The only real legal question left to
be determined if a determination
should ever become necessany is,
"could the county court terminate the
existence of tbe streets runnlug
through tbe square, arter having open
ed them aud people bavins; purchased
property iu the vicinity of said streets,
with a view of their existence." The
county already having the fee in said
streets, or the legal title thereto, could
not it seems to ine maintain a suit to
quiet Htle, at least until some
oue asserted title adverse to the county
and did something In that connection
that would constitute a cloud on the
couuty's title.
Finally as to the commencement
and termination of the recent litiga
tion between the city and auniy: The
first complaint attempted to quiet title
to the four enclosures, leaving out the
streets entirely. Mr Scarborough ap
peared to defeud that complaint. I
think Mr Bilyeu had nothing to do
with tbe esse at that time. Tbe court
sustalued a demurrer to said cotnplalut
aud Mr (Scarborough filed an amended
complaint, and on examination of tbe
same District Attorney Browu con
eluded that nothing could be decided
advantageously to the county on the
amended comprint, and moved its
dismissal. Thep a new suit was
brought aud on demurrer to the com
plaint the court decided lhat the com
plaint on its face stated a cause of suit
which, of coii'-ee, would require the
city to answer. I wa of the opinion

eveut could be determined on the

the court's decision might be. In that
view I was sustained by several of the
members of the Eugene bar, aud also
by V E Yates, district attorney. The
ounty court took the same view of
the matter and ordered the cause dU
missed. If the county had finally
won the suit it would have been In the
judgment ol tbe county court a barien
victory, hence the order of dismlsal.
I do not enter this discussion in the
spirit of a coniioversilist but simply to
set the flic's before i lie people. It is a
matter of Judgmeut with the county
court as to whethei Lane couuty Bhall
have a new court house, and where it
shall be built. Upon those question I
have nothing at this time to say. I
heard many inaccurate statements aud
much nonsensical talk on these sub
jects In the court house last Saturday
afternoon, but I take no further notice
of that in thiM article. Que thing fur
ther I wiah to say before closing this
article; that ia Mr Bilyeu'a connection
with the above named litigation ap
peared to he peifectly legitimate, and
I do not see why, nor do I believe any
blame attaches to him.
