A plain, impartial statement of tho Union plan of tho populi.-t mid democratic parlies will certainly open tho eyed of the greatent doubt er. When the populist parly met in convention in this city in Feb ruary, the democrat (tent them a courteous commiiication asking for a conference, with tho intention of consummating u fusion. Judge Cooley of Mi higan was called upon to decide H ipiestion of the relative rights of a pedestrian and a wheel man, and in haiidi!) down his de cision hecoveicd not only the case in hand, but included in his decis ion ihe Pillowing summary of the law which will prove exceptionally interesting and valuable at this lime, when the cvclists of this coun try do not understand what legal privileges they enjoy: First Municipal corporations or cities are liable to a bicyclist for injuries incurred by reason of de fective roads i. e., as unguarded embankment, u deep rut, a looso stone provided ho is not guilty of contributory negligence. A city is under no special obligation to vvliei'l men. and the defect must ho such as to cauco injury to vehicles in general. A bicyclist injured while riding on Sunday for pleas ure or business cannot recover in States where Sunday laws aro in force. Second A wheelman has a riuht of action against tho driver or owner ol a vehicle who wuiiuuy or neclimutlv causes a collision or damage to bis wheel while leu standing hy the streut.corb or road side. It is the duty of the wheel man, however, to avert collision if possible, and he cannot recover damages if his own negligence is ihe proximate cause of the injury, I'omidaincd ol. Third A traveler riding on the left hand sido of the road probably assumes all risks, and is prima facie cuiltv of negligence. Fourth Vehicles going in tho samo direction, the hindermost may pass i. n either side. Fifth sidewalks arc exclusive ly for foot ii.issenif.ers, but a foot passenger has u right to walk in ilie hichwav. and is entitled to cross tho strei t where he may elect, but is guilty of negligence if he at tempts to cr.i-s ahead of a v hide. .Mid the fact that a vehicle is on too wrong bid ol the road is n evi tieneo of negligence in an aeti n for injury to a pe lestrian. Sixth A b cyclist employing an immoderate i In of speed on a ugh way or street nay be liable evilly or criminally in cases of aic dent. If bo recklessly runs his .vhcel against a pedestrian he is liable for assault and battery. Uecklessness will sometimes supply the place of criminal intent, and if a bicyclist kills a human being while going at dangerous speed he may he con victed of nianslaughb r.
