Upon auit to recover the damage thus austained, the company alleged for a defense ihiit the snider had not pnid for a repetition of the mewiage, and tliut he had written it so liadly a to excuse the operator for making a mistake in it. The court de cided that the company hud that riht to insist upon a repetition of a message as a condition of U-iiig held liatiln for , mistakes, lut that such a provision would not excuse mistakes arising from tho negligence of itsVinployes; and the omission of the operator lo have tin badly written message explained to him was adjudged to have lieen negli geuce.
