" Iu the Oregouian of a recent date wo find this. In conversation with Mr. II. C. Owens to day, I learn very much more concerning the Lite decision of Judge Boise concerning the right of the State to tho lands known as swainp and overflowed lands granted by Con gress, first to Arkansas, in 1850, the provisions of which, by act of Congress of 18G0, were extended over Oregon and Minnesota. It appears that these lands were never se lected by the State until the year 1870, when thpiv Wjima the nropertv of the State, and the Legislature of the same year passod an act Kenerally known as the "Swamp Land Act, which jict forth m iletaU tlie manner iu which tliey sliould be cusposeu oi uy uie Stato, to-wit: by tiling on the iune according to legal subdivision, and the payment to the State of twenty cents per acre, and aa first payment on the f 1 per acre. To the judg ment of the boat informed, this would have netted to the State of Oregon nltout the sum of two and one-half million dollars from the sale of these lauds. Congress has, at various times since, granted tho btate largo tracts oi land to aid in the construction of various rail roads and military roads, and the caso decided by Judge Boise goes to this extent: that granU of land to tliese various corporation include the swainp and overllowed lands pre viously granted to the State, but were to the exclusion of these lands. ... The case of Mr. Owens is considrred a test case, and with the above result, and should Judge Boise's opinion be atfinned, will result in great loss to tliese corporations, but in great gain to the State. We are informed that the late Oregon Central Military Road Company, commencing at Eugene City arid extending to tne eastern une ui u had some 250,000 acres of these lauds, which are very valuable, on the line oi tne roau which Mr. Owens has filed on. There is evidently a very funny sort of indi vidual at brge in this community, and an ef. fort should be made to capture him. e have no idea there exists among ns a band of who thirst for even the blood of Chinese. The Eugene correspondent of the Oregonian threatens the person or persons who set fire" to the cabin near town on the night ot the dist uit, wim unenviable notoriety if they do it again.
