The District Attorney Orders Case Dismissed. the Acting on the motion of District At terney S. L. Hayden in the circuit court yesterday morning, Judge Burnett die missed the case against John R. Stock man, the Albany miller and warehouse man, indicted for the shipping of wheat from a warehouse without the consent of the owner thereof. Mr. Hayden took this action on the grounds that the main points relied upon by the defendant in the appeal to the supreme court in re gard to the inethciency of the indictments were not passed upon by that high ju diciary in reversing the judgment of the lower court and still remain undecided an i for the further reasons that the su preme court held virtually that ii was a sale instead of a bailment and that the defendant would be allewed to show by parole that it was a ' mill, ii it was one. instead of warehouse as alleged in the indictment. Mr Stockman was indicted by the grand jury of Linn county, at Albany, on the 26th of Jnne, 1895. The indict ment baa peen heretofore published. An application was made for a change of venue to Marion county and it having oeen granted the cause was tried on Oc tober 15th following, resulting in de fendant being found gui'ty. He was sentenced to one year in the peniten tiary and to pay a hne of $1000. Pend ing an appeal to the supreme court a stay of execution was granted and the case was heard by the last men; ion ed court at a later date. The judgment of the lower court was reversed and a new trial ordered. Statesman. One of Johnson's Bills. Senator Johnson of Linn is frequently heard from. He has now introduced a bill providing that all insurance policies shall be in the following form : "In consideration of (here insert the amount paid) dollars paid, the reception of which is hereby acknowledged (here insert the name of person.com panrsso- ciation or corporation insuring the prop erty) does by this policy insure (here in sert the same of the person, com pan v, association or corporation assured) against loss or damage by fire the follow ing described property, t3it; (here in sert a description of the property insured) for the sum of (here insert the total amount for which all of said property is insured) dollars for the period of (here insert the time.) "In witness whereof (here insert the' proper attestation clause and execution hy the company, corporation, association or person issuing the policy of insur ance ) The assured mast not make any state ment about the property, bat the coaip panv mast find oat everything for itself before hand. A fine of $1000 to $5000 is provided, and the climax is capped with the following: Inasmuch as fire insurance policies heretofore issoed have entailed endless litigation and have defrauded many per sons insured out of their just losses, this act shall take effect and be in force froaa and after its approval by the governor. The bill is at least interesting, and it would be satisfactory to see a policy of the kind mentioned. All the same. on general principles, a ma has a right to make such a contract as he sees fit, in cluding insurance contracts, and it is not probable his rights will be abridged in this respect.
