that tho defendant l ewis, imprisoned in the
common jail, on a rhargo of burglary, while
awaiting lus trcal, broke jail and escajicd,
Ho was afterward arrested on a warrant for
breaking jail, waived eximiuation and was
again commilteil. After bis second incar
coratum he was tried on tho chargo of bur
glary and aeyuitted, and being arraigned for
Uud upon the second chargo, pleait that he
had Ihvu acipittUd of tho chargo of burglary
aud heneo bad been unlawfully confined, and
was ot guilty of tho after chargo. To this
plea a demurrer was interpsed by tho stato,
and sustained by tho u promo court nptm
appeal, and tho defendant sentenced to two
years iu the penitentiary, on tho last charge.

affliction in the family of Hon. B. F. Bon-
liam, of Salem. During the past month he
has buried his three eldest boys, victims of
that dread scourge, diphtheria. On Thurs
day of last week the eldest loy, Frank, was
buried, and on last Sabbath the family were
called upon to follow the remainuof the third
boy to bis last resting place. In this afflict
ive dispensation we deeply sympathies with
the family.

from a horse and killed, and last week we

der for a sidewalk on tha east aide of Ells

A petition from F. OToole asked that the
waste water down Braadalbin street be con
flined in a sewer. In accordance with the
prayer of the petition Mason moved that a
sewer be constructed in the middle of Broad
albin from the south aide of First to the
river, aaid sewer to bo 2 1 feet wide and to
be built of lumber, tho work to be under tha
direction of the Committee on Street, and
to be let to the lowest bidder. Motion car
ried. On uiotio i of Martin tha Committee on
Street! were instructed to draw up plans and
specifications tor the sewer to be built on
Broadalbiu street, and to advertise at onee
for bid for tho construction of aaid aewer.
On motion I tie was added to the Commit

Tho Treasurer's business was then taken
up again, and ou motion of Mason it was or
dered that if the City Treasurer or his bonds
men did not turn over the amount of money

A few days ago we noticed a paragraph in
the ttrrronlan bragging considerably upon
some large potatoes. They were large
"juiU," for they weighed some three or
four pounds, bat this part of the Willamette
Valley still carries the palm on such produc
tions. Mr. Ashby Pea roe, proprietor of the
Albany Ferry, brought into town a few days
ago a potato of the "Peerless" variety which
weighed a few ounces over six pound. Four
others of the same variety weighed 13
pounds, and four others from one hill weigh
ed I2J. Now we are glad to hear that other
localities can raise good, average aizod pota
toes, but we don't want to hear them brag
too much fts long as our community can lay
it over thorn to the tune of about two pounds
to each spud.
