punished, according to law, and take upon

historr, which can never bo forgotten, that
both Houses of Congrcss in'July, 18G1, de
clared, in the form of a solemn resolution,
t that the war was and should bo carried on
for no purpose of subjugation, but solely to
enforce the Constitution and laws : and that
when tr ia was yielded lv the parties in - re
bellion, the contest should cease, with tho
constitutional rights of the states and of in
dividuals unimpaired, i This resolution was
adopted and .sent forth to the world unani
mously by the Senate, and with only two
dissenting voice in the House. It was ac
cepted by the friends of the Union, in the
South a well as in the Xorth, as expressing
honestlv and truly the object of the war. On
the fault of it many thousands of persons in
both sec tions gave their lives and their for
tunes to the cause. To repudiate it now, by
refusing- to the statcs,and to the individuals
within them, the rights which the Constitu
tion and the laws of the Uuion would secure
to them, is a breach of our plighted honor
for whicVl can imagine no excuse, and to
which I cannot voluntarily become a party.
The evils which spring from the unsettled
utate of our government will lc acknowledg
ed by all. Commercial intercourse is im
peded laipital is in constant peril ; public
securities fluctuate in value ; peace itself is
not secure, and the sense of moral and
and political 'duty U impaired. To avert
these calamities from the country, it is im
Deratively demanded that we fhould imme
diately .decide upon some course of adminis
tration hich can le steadfastly adhered to.
I am thoroughly convinced that any settle
ment, or compromise, or plan of action
which is inconsistent with the principles of
Che Constitution, will not only be unavailing
butniscliievous ; that it will but multiply
the present evils, instead of removing them.
The Constitution in its whole integrity and
vigor throughout the length and breadth of
the land, is the bet of all compromises. He
aide, our duty dues not in my judgment leave
us a choice between that and any other. I
believe that it contains the remedy that is so
much needed, and that if the co-ordinate
branches ot the Government would unite up
on k prnisluas they would le fuund broad
caeagk, i-nA strong enough, to sustain in
-time of feace, the nation which they bore
eafeJy through the ordeal of a protracted
.civil war. Among the most sacred guaran
tees of that instrument are those which de
clare that "each state shall have at lea-t one
representative," and that no state without its
.consent sliall be deprived of equal suffrage
in the Senate. Kach house X3 raade the
judge of the electors, return -and qualifica
tions of i:s own members, and may, with
the concurrence of two-thirds, expel a mem
ber. Thus, as heretofore rged, h ad
emission of Senators and Representatives
from any and all of the states, there can be

srho are disloyal will be clothed with the
powers of legislation, for this could not hap
pen when the Constitution and the laws are
enforced by a vigilant and faithful Congress.
When a Senator x Representative presents
-his eertifioate of election, he may be at once
admitted or rejected, or should there be any
quetion"of his eligibility, his credential
may be referred for investigation to the ap
propriate cunimittee. " If admitted to a seat,
it must be upon evidence satisfactory to the
House of which be thus becomes a member,
that he possesses the requisite constitutional
'and legal qualifications. If refused admis
sion "as a' member for a want of "due allegi
ance to tho government, and returned to lus
constituents, they admonished that non but
persons loyal to the United States B ill he al
lowed a voice in the. legislative councils of
the nation r and the political power and mor
al influence of Congress are thus effectively
icxerted in the interests of loyalty to thegov
ernment and fidelity to the Union ; and is it
not far better that the work of restoration
should be accomplished by simple compliance
with the p'ain requirements of the Constitu
tion than by recourse to measure which in
effect destroy the states and threaten the sub
version of the general government? All
