He if ordained by the Common Council of the City of Albany : Section 1 . That the south lmlt of blocks two (2). three (3). tour (4) and rive (5), and the north half of blocks eight (8 nine (9), ten (10; and eleven (11), of the city ot Alba ny, according to the inaps pints' and sur veys of said city, be mid" hereby nre declar ed within the tire limits of said city. Sec. 2. Ail buildings hereafter erected within the fire limits aforesaid, shall have their outside walls and party walls made of hricic, stone, or oilier Incombustible material, and such outside walls and Dartv walls Mia 11 extend from the fotimlatioii to to the top of and through the root of said buildings and the roof shall be corered with tiu or pome other' incombustible mn terial, and the walls shall be so constructed as to separate all woodwork, thnronghly and completely, of the interior anrl exteri or of said buildings from all and every Wirt of the iuterior or exterior of any adjoining building. The term building as used iu this section shall not include privies. Sec. 3. All repairs to buildings con structed of brick, stone or other incombHst ible material, shall be mad to conform to this ordinance. i Sec. 4. Xo woodefi building completed: or in process of construction, within said fire limits, shall ba altered, changed or completed without; the written permission of the Chief Kngineer ot the Fire Depart ment, approved hy the Committee on Fire and Water, which permission shall specify fully the alteration or change required. and no such permit shall be given if the pro nosed ' chalice. No building within' said fire limits shall be removed except to a portion of the lot on which it may have stood to make room for more permanent improve ments, or to a point ouSsitle of the fire lim it. Sec. 6. Whenever any building shall be by any means so much injured as to be. iu the judgment of the Chief Kngineer of the Fire Department and the Committee on Fire and Water, a dangerous nuisance ; or when any wooden buil'ding within the fie limits shall, in the judgment of the Chief Kngineer of the Fire lepartmeiit and the Committee on Fire and Water, be damaged by fire to the extent of one-half or more of its actual value, the Chief Engineer shall immediately cause Ut be served upon the owner or person having control, a notice requiring such irson to remove the same forthwith, and the person receiving such notice shall, within ten days after receiv ing the same, comply with the requirements thereof. Sec. 7. Any person or persons violating any ot the provisions of this ordinance shall lie deemed guilty of a misdemeanor, and on conviction thereed before the City lie corder shall be punished by a fine not less than ten nor more than oiie hundred dol lars, and in default of payment ot such line, shall be imprisoned in the city prison not less than live nor more than thirty days ; and each day ol maintaining or continuing such aforesaid violation, shall be .deemed a new oHi'iice and punished accordingly. Sec. S.
