Circuit Court Attendance at
Court during the present week has
heen quite good in point of numbers,
considering the weather. The case of
J. U. Mar excited more than usual in
terest, and until the jury' verdict of
guilty," was rendered, much conjec
ture was Indulged to B? omsiuers
to the result ot their deliberation. By
some it was thought that the testimo
ny failed to prove a malicious inten
tion, which the law renders impera
tive in order to constitute a clear case
ot perjury. There was no doubt about
Mr. May swearing to two directly op
posite "things, but the prosecution
brought out only an inwrenwi
tive, and hence In the minds of some
a doubt as to his intentional guilt
might exist. The general impression
Is, however, from the circumstances of
the case, tliat the jury could not in jus
tice have arrived at any other conclu
sion than tbey did. The counsel on
both side, the District Attorney and
Powell, p oseeutiug, and Helm. Wil
liams and Dolph defending, attended
to their duties with vigilance and abili
ty. One day during the latter part ot
w l Kilns Keener, who killed
the musician at Harrisburg. was
brought into court and gave bonds in
ttw sum of tiOOO for his appearance
for trial. He is a young man of me
dium height, compactly built, possess
ing broad shoulders and a ueep cucm.
and looking vigorous and strong. He
possesses a firm chin, high cheek bones,
very prominent eyebrows, and a re
treating forehead. IINtyesand hair
are dark, the former piercing. A
mustache is grown upon his upper lip.
u. un nmittv attired, and walked
into court as if he felt he was the ob
served of all observer as he doubt
less was and wanted to appear as un
embarrassed and collected as the aw
ful crime pending against him would
permit. His case at the time of writ
ing this has not been reached, but his
friends are strong in the conviction
tlmt the testimony will clear him of
the charge in the indictment against
him. On Tuesday in the forenoon,
Indian Frank, found guilty of assault,
was brought into Court to receive such
penalty as the Court might see proper
to impose under tlie statute. m
Honor said, "stand up." Frank shuf
fled up in an awkward, gawkish man-1
ner, and, lopping bis head one side,
.spread out Ins broad countenance
much broader, by a bashful, "devil-may-care"
grin, and roguishly look
ing up at His Honor, seemed to say :
Well, fire away, Tyee." "Can you
understand-which would you rather
do, go to jail or the penitentiary ?" in
substance, asked the Court. Frank
straightened his jolly phi, looked at
His Honor blankly, for a moment,
then glancing around the court room,
wiped his lively nose with his coat
sleeve, and broke out Into another
broad grin. There was a grinning
time just then, audience andal! taking
a part. Mr. Helm here explained
matters to Frank, ami through his in
terpretation. Frank responded to the
Court, that it did not make any differ
ejicetohim where be was sent. His
Honor then assessed a fine of twenty
dollars against the good-natured
Frank, after which lie waddled off af
ter the officer to our ten thousand dol
lar jail, to spend ten days.
