Justices' Court A. N. Arhold, J. On
Tuesday. Charles Prescott (colored), formerly a
citizen of Boston (Mass.), was arrested at the
suit of Messrs. Bellinger A Brown, publishers of
the State Right Democrat, Messrs.. B. & B. mak
ing affidavit that the said colored gentleman was
owing them for eight month's subscription to the
Jirmoerat and for advertising in the same, the sum
of seven dollars and a half, and that he was
about gallivanting without due payment thereof.
Mr. Charles Preseott being arrested and brought
before the Court, demanded an immediate trial,
Vpon being asked if he had counsel, he replied
that he had not, that he desired the plaintiffs
should have the privilege of publishing in the col
uinns of the Democrat that one negro had pleaded
bis own ease in Oregon; also, that he had urgent
business below He signed and filed his demurrer
to tbe complaint, upon which the Court ruled that
the complaint was bad, and Mr. Charles Prescott
(colored) was discharged at the cost of plaintiffs.
This sudden and overwhelming defeat of the
editors of " the oldest Democratic paper in Ore-
j;on, in their first attempt to coerce a "nigger,"
will doubtless " sour" them still more againstthe
hated race, and lead them to go after " "nig
gars " hereafter, as well as Chinamen, with " red
hot" Democratic lightning. To be beat by a
"nigger" a Boston "nigger" a "regular
subscriber, too, is too mnch I . - .
Appkcciatiox. Since the settling of the rail- j
road question in favor of Albany, and the agita
tion of the building of the Santiun and Albany
Canal, real estate has rapidly appreciated in this
city. Property that! was offered at $700 a few
months ago, is now held at $1,600. Persons who
were anxious to " sell oat " and leave Albany ,are
now satisfied to hang up " with us, believing
that the future of our city is bright with promise.
Judging from the talk ct the inauguration of sev
eral new business enterprises, and the erection of
new buildings in various portions of our city, the
doming promises to be the most busy and prosper
ous season yet witnessed by tbe " oldest inhab

Messrs. Mark bam A Son hare shipped from
. their wharf during the month of January : 50
boxes eggs, 20 hf bbls dried apples, 14 hf barrels
butter, 30 barrels lard and 14 eases of lard.

The various manufacturing industries and trade
seem to be in a reasonable state of locomotion.
Theso fine day makes us think of green fields
and beautiful flowers, warm tnn chine and' cool
shades, which are soon to be ushered in to our
realisation.
The effort to raise money sufficient to erect a
Baptist church in North Brownsville is meeting
with lively success, and no doubt but the enter
prise will be put through in early Spring.
Mr. Short, who is said to be a fine singist, has
just commenced a singing school in South
Brownsville, at the Presbyterian church.
One of the attractive features of our streets is
to witness the performances of some of our young
men, who bare taken a contract to break and
tame a number of young horses. .- i
Mr. A. Wheeler has presented the publie with
a bran ' span new poster, which speaks far itself.
A material reduction in the retail price of goods
has been made since he opened up.
I promised in my last to inform the readers of
the Rkqibtes how licenses to sell whisky are
obtained in Brownsville precinct. Some time
since a petition -was circulated asking the county
court to grant Charles Bury a license, which re
ceived something like eiehtv names. A remon
strance was also put in circulation, which receiv
ed about one hundred and twenty names, which
was forwarded to the county court at the time
specified by notices which were posted by the
party asking such license. Mr. Bury saw that
the people of the precinct did not wish to sanction
such an institution, and that he was bent, so he
failed to present the petition to the court, and
posted a notice that he would not retail liquors.
Shortly after the following term of court, rumor
said that Bury had obtained a license. In order
that the citiiens of a precinct may be duly noti
fied, and have a voice in determining whether
they will permit such trafne or not, the law pro
vides that notices shall be posted in three public
places in the precinct ten days before the time of
granting such petition. How this law could be
complied with, and not one of the 120 who had
signed the remonstrance one month previous,
know nothing of it, is remarkable. How the
county court could grant such license when the
law has not been complied with in intent and
spirit, in the first particular, so far as the rights
of the citiiens are concerned, is equally remarks
ble. After the license was secured, a friend of
the said Bury told us that the notices were
secretly posted and immediately torn down, and
we think it was done in the dark. To say that
the court had not the right to go back on the tes
timony in the case, and ascertain whether the law
had been complied with or not, is to utter a ridic
ulous falsehood. Courts are always the judges of
the credibility of testimony.
If tbe foregoing are not the facts in the case, we
will thank anybody who will set us right. It
seems that all that is necessary to obtain a license
is to go out some dark night, take a lackey aloni;
post notices and tear them down immediately
draw up the petition, give a dozen customers
free drink to sign it, take your lackey and go be
fore the Linn County Court, and you are all right.
Hoiss Waruiso. The St. Charles Hotel
was opened on Saturday night last, and a general
invitation extended to our eilixens to call, and
partake of a lunch, etc. The Albany Brass
Band was engaged and discoursed sweet music for
the occasion. Mr. Brenner, the landlord, has
iittcd np the hotel in a neat and tasty manner, and
deserves well of the traveling public. A large
number of th.e ladies and gentlemen of our city
passed through and examined the appointments
uf the hotel, and pronounced them good. Suc
cess to the new hotel.. . -
Surgical, Operation. On Wednesday Dr.
Tate, assisted by Dr. Gray, succeeded in remov
ing a needle from the left breast of Miss Ada,
daughter of J. C. Mendenball, Esq. Dr. Gray
administered "laughing gas" to t e patient,
when Dr. Tate succeeded in removing the needle
ia a very short time. The needle had been im

and three years, during which time several efforts
had been made fur its removal, all of which
proved unsuccessful. When removed tbe needle
roved to be quite rusty. !
Cct Down. That majestic monarch of the for
est, the " lone tree," whose branches have been
tossed by the rude winds for centuries past, was
leveled to the ground on Tuesday. It was
prominent feature on First street, but because it
stood in the middle of the side-walk its destrue
tion was called for. Thus disappear one by one
the ' old landmark.."

The Scpssr. Mr. Murray, of the " Overland
Hotel," not to be outdone in generosity, gave a
grand supper Monday night, to which everybody
was invited, free f oharge. The Albany Brass
B&nd was stationed on the balcony of the hotel,
and enlivened the evening with the best of music.
The hotel was illuminated from ceUar to garret,
and everybody and more too were there to enjoy
the festive occasion. The hotel was "jam" full
of people Murray hano idea he had so many
friends and well wishers. The tables were filled
with "good things," and everybody said, and
seemed to feci it, that they were " glad they
come.'' k It is pronounced the gayest supper yet
gotten up ia Albany. 'Rah for Murray.
Going to Portland. One of our most talent
ed business mea, K. F. RasselL Esq;., of the law
firm of Russell A Elkins, informs us that be in
tends leaving us in a v weeks, to take np bis
residence in Portland. During an active and
aueoeesful business career of several years in this
city, Judge Russell has made many warm and true
friends, who will be sorry to hear of his intended
removal. The people of Portland will tod the

Discharged. Archibald Rader, arrested some
time since charged with the crime of bigamy
was discharged on a writ ot habeas corpus on
Monday the Court holding that the commitment
was defective, and that there were not facts be
fore the court sufficient to warrant commitment.
Ha was subsequently arrested, charged with
forgery, and was to have a preliminary examina
tion on Friday yesterday.
"Public Ledger Alwakao.' -e have re
ceived this almanac for 1870, published by Geo.
W. Childs, Esq., proprietor of the Philadelphia
Ledger. It is a pamphlet of 56 pages of facts
and figures of interest to every reader, neatly
printed on clear white paper, and is a most valua
ble work for reference, especially in historical and
political matters. Mr. Childs published some
80,000 copies of the almanac as a Christmas
present to subscribers of the Ledger. Of course
such liberality will be appreciated. : "
"Facts About Cuba" Is the title of a 32
page pamphlet that has reached ns, published
under authority of the New York Cuban
Junta.' The printing is neat enough, but the
feliow that made up the forms must have served
an apprenticeship in the late Courier or Signal
office. That's all.
Personal. We had the pleasure of a call
from our old friend, Mr. I. S. Waldrip, late of
this citv. but now of Yamhill county. Himself
and family have enjoyed the best of health since
they left us, but they have found no place that
eeemed so mnch like borne as Albany.
