has entered a plea in b ar in his
case, alleging that he w as caused
to testify before the grand ju ry
w hich indicted him for the alleged
assault.
In his plea he sets forth that u n ­
d er the constitution he cannot be
m ade a w itness against him self
and that he w as sum m oned to a p ­
pear before the grand ju ry and
th ere subjected to questions by th e
d istrict attorney. He alleges th at
th is sam e grand ju ry re tu rn e d an
indictm ent against him on t h e
testim ony w hich he gave.
He declares th a t he supposed he
w as testifying in connection w ith
a com plaint w hich he had lodged
against the shot and clay pigeons
used by th e gun club w hich fell
on his property.
