tric, October 4. the indictment
charging murder in the second
degree. It required all day to
select the jurors and hear the
statements of opposing counsel.
Mrs. Merlo i defended by II. T.
Bagley. of this city, and S. B.
Huston, of Portland, and K. B.
Tongue, district atUrney. and
his deputy. T. II. Tongue Jr
represent the state. The jurors
are representative citizen and
come from all sections of the
ctunty. They are: Ben Day.

The state ia trying to show
that Mrs. Merlo was desirous of
being rid of her husband, and in
the opening and presentation al
leged that circumstantial evi
dence goes to show that the
shot that killed the husband
were not in self defense. The
defense told the jury that they
would show that Merlo was in
sanely jealous of his wife and
that they had repeated violent
iiuarrels. and that Merlo had
threatened to kill her. It was
contended that on the day of the
killing, Mr. Merlo and her hus
band were in Portland, and that
the husband went home early in
the day. Mrs. Merlo arriving
home just before supper. The
defense allege that when Mrs.
Merlo arrived. Merlo accused her
of improper conduct and threat
ened her life. The statement
then say that Mrs. Merlo left
the house, and Merlo followed
her and assaulted her, and that
ehe then lied into the house,
locking the door behind her.
Mrs. Merlo says that he then
forced hia way into the house
and followed her upstairs to her
room. The tory is that she told
him not to force the door or she
would ahooL The door wa
broken and Mrs. Merlo. accord
ing to counsel, says her husband
advanced and graoided with her.
