M. Donahue, charted with larceny of 500,000 feet of loirs from the land owned by Mrs. Elizabeth Freeman, on the former Otchin place, near Groveland. It appeared from the evidence that Donahue had ne gotiated for some timber and that Mrs. Freeman had set a price upon representation that there was a certain amount of sawlogs in the lot When it came time for the contract to be signed Mrs. Freeman had dis covered that the cruise greatly exceeded that represented by Donahue, and she told him not to cut any of the trees. Dona hue, however, went on the place and cut and hauled otT logs, even after being told by Thos. If. Tongue not to take any timber. he representing Mrs. Freeman. The jury was out about an hour when a verdict of guilty as charged was reached. The jury sent in a plea of mercy to the court however. The jury : Wm Thornburgh, A W Wright John Olson. A V Den ny. Asa sequel to the trial, Bagley & Hare Saturday evening filed a suit against Donahue & Co., for the value of timber and dam- ages. The complaint alleges that Donahue cut 851.44 feet of logs, part of which were sawed into lumber, and part of which were left on the ground. Triple dam ages are asked, the value of the timber being placed at 11729.48. The amount prayed for is there fore $5. 108.
