Judge John B. Waldo, once a
Supreme Judge of Oregon, died
Monday last, at his home in the
Waldo Hills, near Salem. Judge
Waldo was a man of unquestioned
integrity, and had a host of friends
in the state, who will regret his
death.
Mr. Harriman made a loop trip
through Oregon the past week.
While he may have been looking
for railway routes, no promisee
were given on the trip that any
railroad extensions would be made,
at this or any future time, within
this state. What the railroad king
may conclude to do in and for Ore

Seashore This Summer.
REASONS GALORE IN DIARY.
In all three referendum cases of
Robert I. Stevens vs. F. W. Ben
Bon, John F. Logan vs. Secretary of
State F. W. Benson and Eugene
Falmer and Cyrus H. Walker vs
Secretary of State F. W. Benson,
the decisions of the court of Marion
county were reversed Sent. 3. bv
the suprtms court, and the people
win Danoi on tne tnree dujb. All
three opinions rendered were by
judge JtaKin.
These three cases were the result of
referendum petitions presented against
the anti-pass bill, the hill for the regu
lation of sheriffs fees in boarding of
jun:ia nuu nic Biaic university appro1
priation hill.
None of the petitions bad the warning
clause at the bead provided by law, and
the petition against the university ap
propriation had part ot the title of the
act omitted besides.
Suit was brought by Sheriff Stevens
enjoining tu-! secretary or state from
filing the petition on the bill concerning
the feeding of convicts and the cue was
decided in hi favor by Judge Galloway
ui uic circuit court 01 iuarion county.
John F. Lcgan, the real author of the
anti-pass hill, also brought auit against
tne petition against that bill and also
won the case. Both these decisions were
reversed on the ground that the legisla
tion concerning the warning clause was
only meant as an aid in carrying oat the
provisions of the act and waa in no re
spect mandatory.
The Palmer and Walker vs. Benson
case was a mandamus suit brought to
compel the secretary of state to file tie
petition against the university appro
priation bill. This was lost in the lower
courts, but Tuesday won before the su
pieme court, to this petition will be filed
