A matter of great public interest ia
tbe purchase of railroad lands in
tbia county. The enabling act,
under which patent was made to
the 0. A C. R: R., giving them
thousands of acres of land for
building in Oregon, says that the
company snail sen 10 intending
purchasers, not to exceed ICO acres
to each, and that the maximum
price shall not exceed 2.50 per
acre. This has not been don?, and
the lands in question are now worth
millions of dollars. Five have
already filed, and thare are thou
sands of acres of land in North
Washington County which come
under the sarin category. A letter
from the Argus to the Oregonian
elicited the following in an editor
ial:
Many persons are rushing to "locate"
homes as "actual settlers" on ranroau
ifrant lands of the Oregon & California.
As a method ortrstuijc Die fsserted riant
of the railroad to hold fee simple title in
the lands, this aouattine is well enougn.
perhaps. But all the landseekers should
understand that the outcome of their
clainu is doubtful and that if they spend
any considerable amount of money or
effort to nain possession they have no
- ... 1
L'uaraut'.-e ol success in tn enu.
The railroad sliouui te neui sin :uy 10
the terms of the land grants of 1H66-70,
and be forced to sell at fa. 50 an acre, as
it agreed to do when it accepted tbe
terms of the grants. There is strong
t'round for believing that the railroad
canoe so Held, tins is me opinion 01
Attorney-General Bonaparte and Land
Commissioner Ballincer. But it should
be kept in mind that a confusion of tech
nicalities will be thrown into uie contest
and that unless the procedure shall be
well chosen, suits of individuals to lay
claim to lands will come to naught. The
meaning of '-actual settler" will lie a
hard-fought issue. It is likely to con
fine the contest to subjects outside the
real ouestion in dispute. Landseekers
are likely to be thrown out of court for
inability to establish their right as actual
settlers or as complaints against uie rail
road. Can a man be:ome a settler on
land not his? Is he not .rather a tres
passer? Bv what riaht would he claim
as much as 160 acres? The law does not
sav that the railroad must sell a settler
160 acres: onlv that it must sell him no
mote. Might not the railroad act with
in the law by selling only one acre, or
half an acre?
The justice of the case U plaiu. It is
contained iu the granting act: "Pro
vided, that the lands granted by the act
aforesaid shall le sold to actual settlers
onlv. in Quantities not greater than one
quarter section to one purchaser and for
