Miller was charged with a viola
tion of a city ordinance, the de
fendant and Marshal Lenniville
having a little trouble on tbe street.
Tha case wss taken before Record
er J. jC. Clark, who dismissed tbe
caee upon demurrer. Later on
Clark resigned and Walter lloge,
of the Times, was appointed Re
corder. Miller was again faced to
the charge, and E. B. Tongue again
defended, interposing the plea that
Miller had already been in jeopardy.
Recorder lloge refused to entertain
the demurrer, and Miller was fined
$.'X) and costs. List week Attorney
