Why Change a Tried Senator
For an Untried One?
PLACE CITIZENSHIP ABOVE MERE PARTISANSHIP
Everyone knows that Senator Chamberlain has made a wonderful
record for Oregon and for the country. No one is attacking his record
in this campaign, because it is flawless. Shall he be sacrificed on the
mere suggestion that he may at some future time, and on some possible
future question, be at variance witfi a Republican or a Democratic
President, when he has stood always four square on everything that
affects the country or his state?
Shall we dismiss an efficient, competent and trained Senator for
an untried, inexperienced one?
Shall we lose his position and influence on the Commerce Committee
of the Senate, where he and Senator McNary, both from the same state,
are serving, and elect a man who cannot possibly be placed there under
the rules of -the Senate?
This is what it means to vote the Republican ticket straight.
His record shows real Americanism, and no one knows this better
than the soldiers who served in the world war.
Members of any party can vote for him by putting a cross between
his number, 37, and his name, on the ballot.

Portland Woman Involved in
Idaho Land Suit; Property
Rights Asserted.
An exception to the generally-accepted
belief that drama and pathos
are unknown quantities in civil suits
at law Is found in the recently de
cided case involving the property
rights of a Portland woman, Mrs.
Julia Green Graef, in the estate left
by her father, R. E. Green, of Boise,
Idaho. The case was decided last
week in the Idaho district court,
southern division, on a uit brought
by Hugh Montgomery of Piatt &
Piatt, Portland attorneys, for Mrs.
Graef.
According to the facts as repre
sented in the court decision, which
set aside the will in which Green left
all his property to his son-in-law,
J. L. Niday of Boise, there was evi
dence of undue influence on the part
of Niday, the court holding that it
was unreasonable to suppose that the
aged man would give all his property
to his son-in-law without thought of
the rights of the other heirs.
Green, according to testimony
brought out in the case, came to
Idaho about 1890 and took charge of
an irrigation and canal system for
an eastern company. As the years
passed he himself acquired a large
tract of the land in the system which
later became worth in the neighbor
hood of J25.000. Following the death
of his wife in 1909, Green became
heavily involved in debt with the re
sult that his property was mortgaged.
Niday, his son-in-law, thereupon
came to Green's assistance and a set
tlement of the debts was brought
about, and the aged man, then 78
years old, went to Boise to live with
Niday in 1914. Between that time
and the time of his death in 191S
Green deeded all of his property to
Niday for a consideration of $1, leav
ing himself entirely penniless.
Evidence introduced in court tended
to show that the aged -man bitterly
regretted his act, but was powerless
to undo it. Niday's defense was that
he had helped his father-in-law
through his various financial diffi-
d Mayor
culuties and that the mortgages were
equal in value to the property Itself.
The court set aside the deed and
ordered a settlement with the heirs
on a basis of interest on all money
paid out by Niday, together with rea
sonable attorney's fees and real estate
commissions for the various trans
actions involved in the care of the
property.
