railroads, made a humiliating blunder

It will be recalled that the report
on free psses submitted to the senate
by Walker 1. Jlines. director-Kenerat.
showed that on April 4. 1913. such
passes were granted to air. McAdoo,
his wife, his son Kobert if. SIcAduo
and his daughter Sully McAdoo. The
reason assigned, for granting: ,he
passes to the McAdoo family is that
the former director-general la In the
service as "special counsel lor the
state of New York.
lMrector-tleneral Hlnes explained to
the senate that In Issuing passes good
on railroads In federal operation and
rood for sleeping-car and parlor-car
accommodations, the railroad admin
istration had been guided by the ea-
tabllshed practice adopted nnder prl
vate control to conform wun tne pro
visions adopted by congress In tha In
terstate commerce act and In amend
ments thereto governing frea passes.
Hut It Is not a difficult matter to
jude whether the railroad adminis
tration was within the law, as con
strued by the Interstate commerce
-ommlssiun. in issuing the passes to
the McAdoos. Conference ruling fio.

"The commission adheres to the

unlawful for an Interstate carrier to
issue time passes to local attorneys,
surgeons and others who do not de
vote substantially all their time to
the work or business of the carrier.'
Jn conference ruling No. 9-a the
commission said: "The commission at
this time (October 12. los.) makes
the announcement that It will recom
mend the Indictment and prosecution

passes by, any person not included
within designated classes to whom
f re passes may be given by carriers
subject to the act to regulate com
merce as set forth In said act.
If there be anyone who still con
tends that the pass was Issued by the
:. director-general by special powers re-"?ts-(1

by the federal control act. the answer
Is that lilrector-Ueneral Mines took
no such position In his explanation to
the senate. Any suspension of the
interstate commerce law ' under the
federal control act was by order of
the president, and certainly no one is
golns to say that Mr. Wilson set aside
the powerful law governing all of the
railroads of the United States to have
free passes issued to his aon-ln-law
an. family.
Neither will anyone rise to say that
the Job of "special counsel for ' the
state of New York" constituted any
large part of the business of Mr. Mc
Adoo. who Is understood to be receiv
ing a fabulous salary as counsel for
Charlie Chaplin, pouelas Fairbanks.
Hill Hart. Mary Plckford and other
film stars. In which rapacity he has
done most of his traveling on his free
railroad and Pullman accommoda
