BOISE, Idaho, Sept. 27. (Special.) rl'he pending trial of Charles S. Moodv, former atl jutant-general of the state, and member of the legislature, on the haige of making a false certificate to a voucher for traveling expenses while adjutant-general, -will attract tate-wide interest and will have no .ittle bearing on possible political de velopments. Ihe trial is holding the ittention of toth republicans and iemocrats, for Moody is a prominent lemocrat and has been active in party iffairs. He was named by Governor Mexander, democrat, as adjutant-gen eral, holding that office the two terms that he was chief executive of Ihe state'. Mr. Moody Pleads Not Golltj-. Mr. Moody, who was arraigned in the district court here this week, nieaded not guilty to the charge. The defense filed a demurrer to the com plaint together with a motion to set aside thfl information on the grounds i hat it did not state a 'public offense Ijnd further that a proper preliminary examination was not conducted in the justice court as provided by the con stitution. The demurrer and motion were taken under advisement by Tudge Keddoch. The defense contends hat a deposition must be filed show ing every item of the offense before an information can be brought, and unless these depositions show that a public ofi'ense has been committed, the information is not valid. Prominent Men Are Aides. That Mr. Moody proposes to fiyht hard the charges presented by the .itate is considered apparent from the nalaiy of legal lights he has em ployed. Among them are J. T. Pence, former chairman of the democratic oiate committee in Idaho and a promi nent attorney of Boise, and Herman H. Taylor of Sandpoint, former lieutenant-governor of the state and a promi nent republican. When the charge nus first filed against Moody in a legislative report during the session of the legislature last winter, friends of the former adjutant-seneral in northern Idaho, particularly at Sand point, where he lived, voluntered to furnish an attorney to present his .ase properly. This attorney is Mr. Taylor, who was prominently identi fied with the northern Idaho district draft board as its secretary during the war and held the rank of major. Expenditure la Questioned. oon after the legislature convened reports were in circulation that an in vestigation of the adjutant-general's department would be made. Later the legislature gave authority to employ accountants and auditors to investi gate all departments. The state af fairs committee of the two houses wud pjven general supervision over Una investigation. Some time later the committee reported a number of irregularities in the handling of the appropriation of the adjutant-gen-rial's department. Included among the Items cited was the one involving the expenditure of 1176.63 while Moody was east. In answer to the charge Mr. Moody took the floor of the house of representatives and asserted that every "single red cent" spent in his department could be accounted for. He explained that the country was at war when he made the trip east and that he had been called to Washing ton by direct order of the provost marshal-general. Mr. Moody had been in charge of enforcement of the draft law in this state. Direct Charges filed. Counsel for Mr. Moody asserts that at the preliminary examination given Mr. Moody when he was bound over to the district court to stand trial, duplicate state vouchers were intro duced and testimony eriven to the ef fect that they had been filed, but no testimony was introduced as to their lalKity or truth. The legislature adjourned after the special committee presented its find ings in the Moody case, without tak ing action except to refer the sub stance of the reports to the attorney peneral. It was laten that County Attorney Delano filed the direct charge and complaint against Moody. SALARY REVISION HEADY SEW SLATE FOR CITY EMPLOY ES BEFORE COU'CIIi SOOX. Majority Supposed to Favor Changes Recommended Pier May Put Vp Fight. Kevised slate of salaries for city employes, promulgated by the stan tlardization committee, will be pre sented to the city council for adoption or rejection Wednesday, according to City Commissioner Pier, chairman of the committee. A few changes have been made since the. informal meeting: when the proposal was first submitted. These consist of correcting some errors which were in the first list, accord ing to Commissioner Pier. Commissioner Pier gives an inkling that he stands ready to fight for his proposal. Commissioner Bigelow has refused to commit himself as to his possible etand on the proposal, al though he worked with the com mittee during the past week com piling recommendations for the fire and police bureaus. It is generally believed that Com missioner Bigelow will refuse to vote for many of the proposed increases and that in this position he will have ine support of the mayor. Commissioner Barbur has been away, but is known to favor the list of salary changes to be submitted Wednesday. Commissioner Mann also ia supposed to favor the changes, giving a majority to support the salary revision ordinance. The proposed changes are contained in one ordinance, which will make it necessary for a member of the coun cil to vote against all salary increases in the event that he favors some but cannot support others. ' The ordinrnce provides that the changes be retroactive to Septem ber 1. Prominent Uriton Dead. LON'DO.V, Sept. 27.
