CONCORD, N. H., Nov. 8. The requi
sition of the State of New York for
Harry IC Thaw was honored today by
Governor Felker. The case now goes
to the Federal courts, where a writ of
habeas corpus is pending.
Thaw was not present when the Gov
ernor's decision was announced. He
will remain here In the Joint custody of
United States Marshal Nute and Sheriff
Drew. His attorneys announced to
day that they would file Immediately
an amendment to their petition for the
writ, to make it conform to the new
indictment found by the New Tork
County grand Jury.
The writ of extradition was granted
on the Indictment solely, the Governor
refusing: to so into the questions of
sanity or of guilt or innocence.
Indictment la Sufficient.
In granting the extradition Governor
Felker said in part:
"By the petition of Governor Glynn
and the accompanying papers, it ap
pears that the grand Jury of the county
of New Tork has duly returned into
open court an indictment against Mr.
Thaw. That is sufficient to warrant
the arrest, arraignment and trial of the
respondent, if he may be found within
the state wherein the indictment is
pending. It is furthermore sufficient
to establish that Mr. Thaw Is if found
in any state or country while such
indictment is pending a fugitive from
justice.
"The provisions of the Federal Con
stitution and the acts of Congress en
acted to give force and effect thereto
as construed by the court of last re
sort on such matters, limit me to the
consideration of the question whether
the person demanded has been ' sub
stantially charged with a crime and
whether he is a fugitive from Justice.
Such was the decision of the Supreme
Court of the United States in the most
recent case wherein a sister state de
manded of New Hampshire the inter
state rendition of a person within her
border (Muncy vs. Clough, 196 U. S.
S72, decided In 1903). In that case it
was decided by a unanimous court that
the proceedings in the matters of this
kind before the Governor are surnrnary
in their nature. f The person demanded
has no constitutional right to be heard
before the Governor on either question
and the statute provides for none. To
hold otherwise would in many cases
render the constitutional provision, as
well as the statute passed to carry It
out, wholly useless.
Mental Condition IVot Considered.
"I have nevertheless, owing to the
urgency of the demands of his counsel
men in whose integrity I have confi
dence and for whose opinions I enter
tain deep respect given the fullest
possible opportunity for the expression
of their views. With profound respect,
therefore, 1 am unable to view my duty
In the premises as including an inves
tigation of Mr. Thaw's mental condi
tion or of the counsel for the State of
New York as to the probable guilt or
innocence of the accused.
"To do so would hardly be consistent
with the mandatory provision of the
Constitution that a person charged
In any state with treason, felony or
other crime, who shall be found in an
other state, 'shall, on the demand of the
executive authority of the state from
which he fled, be delivered up."
"That would, furthermore, involve an
attempted supervision by myself over
procedure of courts of another state in
a manner beyond the power of such
state control. Such & course would,
likewise, involve an inquiry into the
motives of the authorities of the de
manding state. . Any of those would
manifestly lead to the virtual suspen
sion and eventual nullification of pro
visions of the Federal Constitution.
"I have and I shall continue to as
sume that the course of the State of
New York does and will demand the
full appreciation of the dictates of
fair play and a righteous and equal
administration of Justice."

If she has any children by her re
cent marriage, she will be not only
their mother but also their sister-in-law.
BALL HERO SHUNS STAGE
Wally Schang Turns Down $5000
Vaudeville Contract.
BUFFALO. Nov. 3. Wally Schang,
the ex-Bison and the wonder of the
baseball world, turned down a con
tract of ?5000 offered by a represen
tative of a New York vaudeville agency
for his services for ten weeks on a
vaudeville circuit.
Under the terms of the contract
Wally was to appear twice a day, do
ing a "turn" of about 15 minutes in
length and was to have received J500
a week. The Wales Center boy flatly
refused to consider the offer, not be
cause he considered the price too low,
but because he had to help his dad
"fetch in the taters."
This is the second offer to go on the
stage that Wally has refused since
he proved himself a hero in the world's
series. The day after the series ended
In New York he was made an offer of
$500 to appear at a local burlesque
house, starting Tuesday night, and
closing Saturday. Wally also flatly
refused to consider the offer.
INVESTIGATION IS ENDED
Home Concern's Telephone Fran
chise at Spokane in Jeopardy.
SPOKANE, Wash., Nov. 8. (Special.)
Following the investigation of the
Government officials into the telephone
merger In Spokane, which returned the
fact that the Home Company is con
trolled by the Bell, Commissioner C. M.
Fassett today took teps toward a re
vocation of the "automatic" franchise.
In an official communication to Cor
poration Counsel Stephens, he asks that
the company's legal staff examine the
Home franchise and report on the pos
sibility of its abrogation.
The Spokane phase of the phone mer
ger hearing came to an end yesterday
afternoon. The officials interested in
the probe will continue their investiga
tion Monday at Butte. They will take
testimony at Helena, Billings, Boise and
Denver, in an effort to further disclose
the grip of the phone octopus in the
United States.
After those hearings the Federal of
ficials will probably go to Chicago and
New York before a final report is made
to the Government. Bitter opposition
of the Bell Company to the smaller con
cerns was revealed in the testimony
brought out yesterday afternoon. It
was also shown that the Bell organiza
tion owns 25.605 shares of stock in the
Home Company.

SEATTLE, Nov. 8. At the closing
session of the Western Labor Immigra
tion Conference a resolution was adopt
ed today calling upon the conference
to petition Congress to enlarge the
scope of the Chinese exclusion act so
that It will apply to all Asiatics, in
cluding the Japanese. This resolution
will be presented at the Federation of
Labor convention.
The resolution was offered by Paul
Scharrenberg. of the California Feder
ation of Labor.
An event of today's meeting of the
conference was an attack made upon
the regents of the University of Wash
ington by Charles Perry Taylor, sec
retary of the conference. He scored
the regents for permitting members of
the faculty to organize classes of Chi
nese students and bring them into this
country to receive instruction in
schools and colleges of the Pacific
Northwest.
GREAT SURGEONS GATHER
Difficult Operations to Be Performed
at Clinical Congress.

CHICAGO, Nov. 8. Surgeons began
gathering here today for the fourth
annual meeting of the Clinical Congress
of S'lrgeons of North America, to be
in session all next week. The congress
will bring here most of the eminent
surgeons in the United States and many
from Canada and Europe.
Clinics will be held twice daily at
the principal hospitals. Noted special
ists will perform difficult operations
and explain them to their colleagues.
The sessions of the congress will be
held in the evening.
Baby Judges Named.
HOOD RIVER,. Or., Nov. 8. (Spe
cial.) Dr. F. C. Brosius, Dr. D. F.
Watt and Dr. E. D. Kanaga, three local
physicians, will be Judges of the Baby
Show at the White Salmon Fair to be
held in the neighboring city across the
Columbia River next Wednesday. The
fair is creating a great deal of interest
among local people, who will visit
White Salmon during the event.

ST. PETERSBURG, Nov. 8. (Spe
cial.) M. Chaliapine, the great Russian
opera singer, who scored such a suc
cess in London and New York; has been
ill at Gurzoof, near Yalta, in the Cri
mea. He is suffering from inflamma
tion in the ears, and it is possible that
an operation will be necessary.
Lewis . Loses December Court Term.
. CENTRALIA, Wash., Nov. 8. (Spe
cial.) Owing to the small number of
cases on the docket and the holiday
season. Judge Rice announced today
that there would be no December term
of the Lewis County Superior Court.
