WASHINGTON. Dec. 14. The testi
mony upon which the House managers
ask the Senate to convict Judge Arch
bald, of the Commerce Court, of mis
behavior and misdemeanors In office
was concluded today. On Monday at
torneys of the accused judge will begin
the presentation of the witnesses for
the defense.
Today's witnesses included C. Larue
Munson. of Wllliamsport, Pa.; Samuel
11. Swingle, of the Premier Coal Com
pany of Scranton; Fred W. Jones, of
the Delaware & Hudson Coal Company;
O. H. von Storck, a Scranton lawyer;
IV. W. Rishlneer, a coal man of Scran
ton; W. M. Ruth, bank cashier of Scran
ton; J. R. Wilson, secretary of the
Scranton. Honduras Mining Company;
Kdward R. W. Searle, clerk of the Fed
eral Court in Middle Pennsylvania, and
T. F. Farrell, of New York.

Most of the witnesses testified In
regard to Judge Archbald's alleged
activity in regard to the culm bank
leases and the discounting of notes
bearing his name. Munson and Searle
were examined in regard to the raising
of $500 as a purse toward defraying
Judge Archbald's expenses on a trip to
Europe in 1910. Mr. Munson said he
was asked to subscribe to the purse
and that he declined because of his
high regard for the judge and his
desire not to embarrass him.
"I would like to say." added Mr.
Munson, "that I always found Judge
Arch bald absolutely fair and impartial
and that I never tried a case before a
more honorable and upright Judge
than he."
Mr. Searle declared that since testify
ing before the House judiciary com
mittee he had refreshed his memory
in regard, to the purse and said the
plan to give it originated in talk about
giving a dinner to the judge before his
departure for Europe. It developed
that only eight or nine could attend
the dinner so those who had planned
the affair agreed to give the judge the
money raised. They feared that the
judge would refuse it and so put the
money in an envelope marked "sailing
orders, do not open until two days out.
Judge Admits Debt.
. Mr. Searle said Judge Archbald came
to him upon receiving a letter from
the judge's wife s cousin, Henry W.
Cannon, inviting him to be his guest
on the European trip. The witness ex
plained that Judge Archbald hesitated
to accept because those he owed might
feel that be should have .". used the
money it would have cost for the trip
In paying his debts.
Mr. Searle was pressed as to the
judge's debts. He Insisted that there
were debts, but that the judge's credit
was good.
"Judge Archbald has been held and
is now held in the highest respect by
the people of Scranton." said the
witness.
COAL - REBATING. CHARGED
Xew York Central Accused of Favor-
Ing Concern Owned by Relatives.
WASHINGTON, Dec 14. The Gov
ernment's threatened prosecution of
the O'Gara Coal Company and officials
of the New York Central lines for al
leged rebating will come to a focus in
Chicago not later than Tuesday.
The case, which has been under In
vestigation by the Federal grand Jury
In Chicago, is said to have developed
evidence upon which the Department of
Justice has been considering the draw
ing of Indictments. It is said the pos
sibility of compromise by the Impost
tlon of large fines has been one of the
settlements proposed.-
It Is alleged the New York Central
lines paid rebates aggregating 960,000
to the O'Gara Coal Company, a Chicago
concern, in which certain relatives of
the railroad officials. are interested.
JEWELS PAWNED FOR BAIL

SAN FRANCISCO. Dec. 14-Pawning
her Jewels to raise the necessary money,
Mrs. Vivian Merlin Lyons, ex-wife of
William C. Lyons, a Denver politician,
who is now charged with having at
tempted to murder Robert J. Wldney. a
Los Angeles realty broker, in her rooms
In a San Francisco hotel two weeks
ago, was today released from prison
on $1600 bail.
The woman had remained in prison
since the shooting, with ball fixed at
2500. Her attorneys represented to
the court that Mrs. Lyons was in a
weakened physical condition, and the
plea brought the desired reduction in
bail. . The jewels the woman wore were
then taken out and placed In pawn.

NEW YORK. Dec. 14. Miss Carol
Harrlman, daughter of the late E. H.
Harrlman, will be compelled to carry

dance in which she was to have ap
peared at a charity function.
Miss Harrlman was seen to limp as
she left the stage after the rehearsal.
She explained that she had merely
wrenched her foot, but examination by
a surgeon showed that she had broken
a bone In one of her toes.
WOMAN SLAYER MUST DIE
Bride Convicted of Murdering Her
Husband for Money.
PHILADELPHIA. Dec 14. Mrs.
Frieda Trost, who was on trial here
this week on a charge of having killed
her husband, William Trost. was con
victed today of murder in the first de
gree. The commonwealth charged that Mrs.
Trost within one week after ber mar
riage last August gave Trost poison in
order that she could obtain his estate,
valued at less tban $10,000. i
