OYSTER RESERVES SEIZED
State Patrolmen Claim Tldcland
Holders Are Stubborn.
OLYMPIA. Wash., April 8. Special.)
Today, the Attorney-General's office
was notified by the patrolmen on the
state oyster reserves at Mud Bay and
Oyater Bay that the owners of the
adjacent tldelands were tongingr for
seed oysters, although the -Season does
not open until April 17, and that In
addition they ordered him to let them
alone. clalmlnK thdt they owned the
land.
They contend that under the pro
visions of the Miller-Whatcom bill,
passed by the last Legislature, owners
of the tldelands between mean, low
and extreme- low tides acquired con
trol of the state oyster reserve situat
ed In narrow bays - or Inlets. They
claim that In cases where the channel
Is so situated that at extreme low tide
the spit Is bare they own ,the
entire channel and therefore the state
oyster reserves." The state, however,
is not going- to yield and will retaliate
by seeking; an Injunction against the
removal ot seed oysters as well as
Instituting criminal proceedings
against the oyater men for trespass.
The bill in question, which Is chap
ter 3( of the session laws of 1911.
passed both Houses by a large vote and
carried an emergency clause, as it was
explained that It was merely an at
tempt to correct an error made by the
state. If the oyster men win, the
stale's oyster reserves, valued at thou
sands ot dollars, will be practically
lost. The legal fight will probably be
started Monday.
Marshal Attempts Suicide.

United States Marshal Ned Green
kissed his wife good-bye today at the
home of his brother-ln-law,Vern Hunt,
at Kamiah, Ida. who walked half a mile
to the bank of Trawler Creek and was
found tonight with a bullet hole in his
bead. At 8 o'clock he was not expect
ed to live. Green was operated on at
Bt. Joseph's Hospital at Lewiston two
weeks ago for appendicitis and Is Is
believed the illness preyed on his mind.
He has a wife and two children.,

cline. It was a uervous day for traders In wheat.
Early In the session the market received
a big stimulus from dispatches tolling of
continuance of large, sales of wheat and
flour Northwest. However, as tho session
progressed. Kansas City millers appeared
to be selling their May wheat and buying
July Ideal weather conditions Northwest
furnished Tesson also for collapse of buying
fervor. A sudden decline ensued and feel
ing seemed much unsettled at tho close.
High and low levels for May were 8.

The corn market was a rather light affair.

Ther were mall offerings of livestock at
th yards yesterday and trade was of the
usual quiet Saturday character.
Th most Important sale of tha day was a
bunch of yearling wethers, numbering 234
bead, at $3. A few steers sold at 80-25 to
$6.65.
Th week closed with the cattle and sheep
markets steady to firm and with hogs hold
ing their own fairly well.
Receipts for the day were 125 cattle, 254
sheep. 88 hogs and S3 horses.

In a closely contested gam Friday
evening, the Christian Brothers' Col
lece baseball team defeated the Port
land Business College, on the. former's
diamond, by the score of 8 to 7. Du
back, the Christian Brothers' College
pitcher, struck out 17 men. whetstone,
of the ODDOSition nine, was credited
with five strikeouts. In spite of the
suDerior Ditching: of Duback, I'ort
land's few timely hits, coupled with
costly errors on the part of the Chris
tlan Brothers' College boys, secured
for them, by the end of the seventn
inning, the long; end of a 7 to 5 score.
But the tail-end lads did not give up
hope. By a rally in the eighth they
made three runs, thus putting them
selves one in the lead. Portland could
not score again.
Errors on either side were chiefly
the cause of the large score. Both
pitchers did most creditable work,

Manager McCredie is well satisfied
with -the way his team has shaped up
so far in the pennant race, and an
nounces that lie ha secured Pitcher
Fauwell from the Cleveland American
League team. This twirler will join
the Beavers at San Francisco for tho
series' against Oakland, which com
mences Tuesday. According to ad
vices received by McCredie from tho
South, Fanwell Is a left-handed pitcher.
The following telegram was received
from McCredie:
"Los Angeles, Cal., April 8. Club Is
looking good. Our pitchers are going
good, except they are wild, which Is
due to lack of exhibition games. Wo
will probably have Fanwell with us in
'Frisco. If we can hold Henderson our
pitching staff will be as good as any
of them. W. H. M'CKEDIE."

Umpire Miner Joins Army, Where
Danger, He Says, Is Less.
OMAHA, Seb., April 8. (Special.)
Joe Miner, for three years the object
of occasional pop bottles from the
hands of Irate fans, was emancipated
today, when he enlisted In the Army.
Miner has been an umpire in the Texas
League. He remarked at the recruiting
office that ho preferred facing bullets
from the guns of the enemy any day
to an attack of the bleachers. He
was accepted as a musician to be sent
to Fort Worden, Washington. .
Miner began playing ball on the Pa
cific Coast In 1901, and was a mem
ber of several teams in that section
until 1906. He theta joined a team
In the Southern League. He later be
came an umpire and has served In
that capacity for the past three years.
Miner's physique, despite his words,
showed no 111 effect from the attacks
with pop bottles by the baseball
enthusiasts.

cial.) The regular baseball season in
Vancouver will open tomorrow. J. P.
Kiggins, Mayor of the city, will pitch
the first ball and Judge W. W. Mc
Credie has consented to catch it.
Before 2 o'clock tomorrow 50 auto
mobiles, many being from Portland,
will parade the streets with flags fly
ing, and load the way to the old Tri
City ball park, where the Vancouver
Independents will play the Portland
Northwestern League team.
The game will not be one-sided, as
some might think, as there are many
good amateur hall players who live
here who will be in the game tomor
row. Several of them have played ball
for years and some have been in the
minor leagues.

SPOKANE PREPARES FOR PLAY.
Club Buys Site for Courts and Fine
New Clubhouse.
SPOKANE, Wash., April S. (Special.)
Work will be commenced next week
clearing off the scrub growth on the
site for the fine new $15,000 tennis
courts and clubhouse to be built by tha
Spokane Tennis Club.
After considering a number of sites,
the club finally authorized the purchase
of the half block of ground on Twenty
fourth avenue. The 100 feet on tha
east corner will be used for the club
house and lawn, leaving an area of 20(
by 125 feet for the tennis courts. This
will give room for four big courts
which are to be constructed In tho
most up-to-date style. A car line runs
alongside.
The club will spend $5000 In the con
struction of a fine modern clubhouse
which shall have plenty of locker room,
shower baths and women's dressing
rooms on the lower floor, with a large
tearoom and reading rooms on the top
floor, with a wide veranda around three
sides of tho house.'
The club Is incorporated for $15,000
and already has in hand $S100, secured
in the form of 61 $100 stock certificate
subscriptions.

pia and Tacoma high schools contended
in the best game of the season here,
but then Olympia went to pieces and
Tacoma scored seven times in the last
three innings, while Olympia got only
