Today, the Attorney-General's office was notified by the patrolmen on the state oyster reserves at Mud Bay and Oyater Bay that the owners of the adjacent tldelands were tongingr for seed oysters, although the -Season does not open until April 17, and that In addition they ordered him to let them alone. clalmlnK thdt they owned the land. They contend that under the pro visions of the Miller-Whatcom bill, passed by the last Legislature, owners of the tldelands between mean, low and extreme- low tides acquired con trol of the state oyster reserve situat ed In narrow bays - or Inlets. They claim that In cases where the channel Is so situated that at extreme low tide the spit Is bare they own ,the entire channel and therefore the state oyster reserves." The state, however, is not going- to yield and will retaliate by seeking; an Injunction against the removal ot seed oysters as well as Instituting criminal proceedings against the oyater men for trespass. The bill in question, which Is chap ter 3( of the session laws of 1911. passed both Houses by a large vote and carried an emergency clause, as it was explained that It was merely an at tempt to correct an error made by the state. If the oyster men win, the stale's oyster reserves, valued at thou sands ot dollars, will be practically lost. The legal fight will probably be started Monday. Marshal Attempts Suicide. 8POKANK.
