Fortieth street today elected William
Barnes. Jr.. of Albany, the bitterest
foe of Colonel Roosevelt In the
recent party dissension, to the state chair
manship to succeed Era P. Prentice,
the representative of the Roosevelt forces
for whom Timothy I Woodruff was
ousted.
All the proceedings took place behind
closed doors. After a few minutes Mr.
Prentice emerged, remarking:
'I'm out and I'm glad of It," lit a
cigarette very nonchalantly and disap
peared In the elevator. (
Instead of nominating candidates the
committee then requested eaoh com
mitteeman to present the name of his
choice for the chairmanship. Secretary
Gleason presiding meanwhile. This took
nearly two hours, as many of the com
mitteemen had a good deal to soy, and
It was 3:10 o'clock before Mr. Barnes'
election was announced, it having been
made unanimous at the suggestion of
Chairman Griscom. of the New York
County Committee, after the Initial show
down Indicated 25 out of 3S votes to be
for Barnes.
In the "Informal ballot." as It was
referred to afterward, seven committee
men declared for Jemea Wadsworth, Jr.,
and five for 9eta H. Heacook. Ur.
Barnes not voting.

position that the presence of the 15 Re
publican members of the West Virginia
Senate, who have hidden themselves In
Cincinnati to avoid the organization of
the State Senate, of which they are
half of the total membership, is not
necessary In order to elect constitu
tionally two members of the United
States Senate.

KETCHEL HIMSELF BLAMED
Dipley Says He Fired When Pugilist

MARSHFIELD, Mo, Jan. 21. Testi
mony in 'the Ketchel murder case
closed today.
Walter A. Dipley and Goldle Smith,
the defendants, testified that Dipley
shot Ketchel in self-defense. They had
trouble, Dipley said, on account of an
alleged assault on Mrs. Smith by
Kechel. The woman testified the pugi
list had assaulted her.
Dipley aald Ketchel came into the
room where he was 6ittt-ng with Goldle
Smith and started a quarrel.
"Then Ketchel unbottoned his shirt
and showed a revolver," the witness
said. " 'Don't start anything, for If you
do I'll shoot you full of holes." he told
me. I saw a rifle standing at the foot
of the bed not far from Ketchel.

Western Pacific Still Snowbound.
OGDEN. Utah. Jan. 21. The Western
Pacific Railroad continues to transfer
its westbound passenger and freight
traffic to the Southern Pacific at Elko,
Nev., owing to the snow blockade in
the Sierra Nevada Mountains. Rotary
snow plows and shovels have been
bucking the drifts since January 12,
but have made little headway. The
storms of the past two days have added
to the difficulty of opening the line.
Reporter's Body Found in Ruins.
CINCINNATI. Jan. 21. The body of
George Hayman. a reporter for the Cin
cinnati Enquirer, was recovered today
from the ruins of the Chamber of Com
merce building destroyed by fire Jan
uary 10. This makes five bodies found.
One. still under the wreckage, is that
of Fred Selm, night engineer of the
Chamber of Commerce.
Leonard to Command Cruiser.
WASHINGTON, Jan. 21. Commander
C. Leonard has been appointed com
manding officer of the cruiser Des
Moines, succeeding Commander John
Luby, who died on board the vessel
while en route from Liberia to the
United States. The body of Comman
der Luby will be taken to Annapolis
for burial in the cemetery of the Acad

Colorado looked doubtfully on the gift

coal bed beneath the surface of the
reservation. Then it was decided that
an agricultural station on the site would
be desirable.
Secretary Balllnger, however, yester
day decided to have the offer of the
property to Colorado recalled, and the
secretary to Governor Shafroth made the
assertion today that this action by the
Interior Department official was due to
the fact that he had learned of the
coal deposits upon tho property.
"But Secretary Ballinger moved too
late," asserted Shafroth's secretary. "The
Governor yesterday mailed a deed of
acceptance of the gift to the Interior
Department. Meanwhile, as certain for
