LOS ANGEUIS, March 12. Prepara
tory to an attack on the $1:5,000,000
estate of the late E. J. ("Lucky") Bald
win, the Arcadia turfman, who died a
year ago. a petition was filed in the
! Probate Court today asking- that a
guardian be. appointed for Beatrice
Anita Baldwin, otherwise known aa
Beatrice Anita Turnbull, who is de-
iclared to be a daughter of Baldwin and
(Lillian J. Ashley.
The petition is si pried by Leo J. Ma
jruire, who asks to be appointed guar
dian and recites that the grirl ''la a
xnlnor and will have property consist
ing of one - third of the estate
of the late E. J. Baldwin, pro
vided that before the computation is
made there should be deducted one
third therof to which the widow would
have been entitled if Baldwin had died
intestate. Thia would make the share
claimed by the petitioner about $5,000,
000 or 6. 000. 000.
Illegalit ot Marriage Admitted.
The petition goes on to state that
Miss Baldwin "was born December 7.
1893, in Los Angeles, and is the legiti
mate issue of the said Baldwin, her
mother being Lillian J. Ashley, who
since has married one Turnbull. She is
the Issue of a void marriage made and
entered into by her said father, Bald
win, and her said mother."
. Baldwin's legitimate issue, according
to the petition, is Miss Baldwin, and her
half sisters, Clara Baldwin Stocker, of
Arcadia, and Anita. Baldwin McClaugh
rey, of Berkeley, Cal.
Statute Relied Upon.
The petition disputes the validity of
the will on all grounds. The basis of
the claim in behalf of the petition is
aft alleged common-law marriage be
tween "Lucky" Baldwin and Lillian J.
Ashley. That the marriage has since
become void is acknowledged, but the
contestants are relying upon the stat
ute which declares that all children of
a void marriage are legitimate.
At the time of the birth of the girl,
17 years ago, a common-law marriage
. was recognized as valid, although the
law of the state has since declared such
a union illegal. The girl is now at
tending a boardirjg-school In Boston
and her mother resides In the same
city.
Beatrice's mother 16 years ago sued
Baldwin for breach of promise In the
San Francisco courts. When the trial
was in progress Mrs. Ashley's sister
became so incensed at the sight of
"Lucky" Baldwin, that she fired a shot
at him.
The bullet missed and Mrs. Ashley
lost the case.
CARNEGIE SEES BIG TREES
Visitor Comments on Men Whose
Names They Bear.
SANTA CRUZ, Cal., March 12. "I
don't care if I miss my train; I would
like to stay here a month." said An
drew Carnegie as he wandered among
the big trees at Santa Cruz today. As
he approached the great trees named
after famous statesmen he commented
upon the men whose names they had
been given.
"I was too young to vote for Fre
mont," said the iron master, gazing up
at the tall forest namesake of the Gen
eral, "but. thank God I voted for Lin
coln." He paid respect to Grant as lie passed
the tree, and approaching "Roosevelt"
removed his hat as he said:
"Roosevelt is- iust as straight a man
as that tree is a straight tree; there
is no sham about him. He is the most
phenomenal man In the world today."
At luncheon Mr. Carnegie responded
to an expression of thanks from Mayor
T. W. Drulland for the library which
he had given the town. He was pre
sented with three small redwood trees
and declared he would take them to
Scotland and plant them- at Skibo.
BOY ATTEMPTS SUICIDE
Reprimanded by Teacher, He Shoots
Himself and May Die.
SHAWXEE. Okla. March 12. Be
cause his school teacher scolded him.
Hadley Baiter, a nephew of Pike Baker,
a wealthy real estate dealer, attempted
suicide here yesterday.
Immediately after the teacher repri
manded, the boy he ran from the school
house to hia home and obtained a rifle.
Going to a nearby barn, he shot himself
through the abdomen. Then he ran Into
a street, and, calling to two women who
were driving by, said:
"I have just shot myself and I am
afraid I am badly hurt. Please take me
to a hospital."
The lad was placed In the City Hospi
tal. Surgeons say he Is dangerously
wounded.
NEW RAILROAD PROMISED
Work on Klectrlc Road at Hood
River to Begin Soon.
HOOD RIVER, Or.. March 12. (Spe
cial.) After an inspection of the Vallev
by A. 9. Hall, an expert electric railway
man, it is announced by J. H. Wilcox, of
Portland, one of the Incorporators of the
Hood River Electric Light & Power Com
pany, that active work will begin shortly
on the proposed electric railroad.
The new company has secured an op
tion on the power site of the Hood River
Power Company, one of the best in the
"Valley, and is also negotiating for other
power interests here.

ROME, March 12. There was hard
ly a minute of rest today for J. P.
Morgan. Viewing works of art, at
tending to correspondence and receiv
ing visitors comprised the programme
for morning and afternoon, and this
evening he dined with the Princess
Teano, who held & reception In his
honor. Mr. Morgan is in perfect
health.
As Mr. Morgan had expressed a de
sire to visit the Borgia apartment 'In
the .Vatican at a time when tourists
were not admitted. Mgr. Mlsciattelll,
.prefect of the Apostolic Palace, today
sent Mr. Morgan a special card of ad
mission Later in the day Mr. Morgan, ac
companied by M. and Mrs. Morton S.
Palon, of New York, viewed the art
masterpieces there, especially those of
Plnturicchlo. Mr. Morgan said that
he would not mind being a life pris
oner in the Vatican if he were per
mitted at all times to look upon such
esthetic perfection.
The financier spent the entire aft
ernoon In his apartment dictating let
ters, examining objects of art sub
mitted for his Judgment and receiv
ing visitors.
Mr. Morgan accepted an Invitation
to act as honorary president of the
foreign committee for the celebration
of the fifth annlverslty of the procla-

Incensed at the Sheriff's refusal to
grant the strikers at the Bethlehem Steel
Works permissllon to hold a women's
and children's parade today, a number
of men alleged to be strikers endeavored
to Intimidate men at one of the gates.

KANSAS CTTT. March 12. All Informa
tlon regarding the Cudahy-Lilllf affair
obtained by the Police. Department was
turned over to Prosecutor Conkling to
day. There are several affidavits from
officers and other parties, but no state
ments from John P. Cudahy, Mrs. Cudahy
or Jere F. Lillte.
Unices request is niado by Iillis for
legal steps against Cudahy, there will be
no prosecution in the case. Lillis has al
ready stated he will not prosecute. Lillls
Is recovering rapidly.
