Man Accused of Outrages Defends
Himself by Saying He Acts Ac
cording to Custom. .
BERLIN. Oct. 19. (Special.) It would
be hard to Imagine a more curious com
mentary on the German colonial scandalB
of last year, and the events which led up
to the dissolution of the Reichstag, than
the libel action of Roeren againsj
Schmidt, the hearing .of w-lch was con
cluded recently at Cologne., The parlia
mentary storms of last December reached
their climax with a series of charges
made In the Chamber by the leader of the
Center, Herr Roeren, who at the time oc
cupied a high position on the judicial
bench, against Georg Schmidt, a former
chief administrative official at Atakpame,
In Togoland.
According to the Catholic deputy,
Schmidt, who was at the moment in the
gallery of the House, had displayed in
his office the manners and morals of a
negro potentate. Of him it was said that
he signalized his arrival at the station by
having tt announced by the public crier
that all the gtrlB of the neighborhood
were to assemble that night for a dance,
which. It was suggested, was a kind of
corybantlc orgle, and that the mothers of
all who failed to put In an appearance
would have to pay a fine of twenty
marks.
He had ordered forty elderly natives to
be flogged for refusing to work at the
fenclng-ln of a tree which it was his de
sire to preserve. A native chieftain,
named Kukowlna. who, on beha.f of him
self and other headsmen, had dared to
complain to the Governor of Schmidt's
arbitrary and Illegal actions, had been
summoned before the station chief and
thrown into prison. A notorious pro
curess, named Ssisagbe, whom Schmidt
had chosen as a mistress, had been ele
vated by him to the rank of queen, en
dowed with powers of summary Jurisdic
tion, 'and invested with a sword, as the
symbol of her office. He had kept a har
em of immature girls, which, according
to native ideas, was a capital ofTence,
and of them, a. certain Abdjao, he had
flogged with a horsewhip. Finally,
he had ciused the personnel of the Cath
olic mission, with whom he had come into
acute conflict through his excesses, to be
dragged out of their beds at dead of
night and imprisoned Hill a peremptory
message came from the Governor, Herr
Horn, ordering their release.
It was to this speech that Herr Dern
burg replied by accusing Herr Roeren of
having attempted to influence .the pro
ceedings then pending against the colonial
official Wlstuba. and so came about the
struggle between the Government and
the Clericals, ending with the dissolution
and a mot d'ordre against the Center.
Bchmldt at once challenged Herr Roeren
lo cast off the Immunity which hedges
words spoken In the Legislature, and to
repeat outside Us walls the accusations
which he had brought forward. The
Catholic leader responded by hinting
that the Colonial official should seek
exculpation In disciplinary proceedings,
which were understood to have been
Instituted against him. Schmidt had,
however, meanwhile retired from the
service of the state, and was no longer
subject to Its disciplinary provisions,
but he took the step of publishing an
open letter. In which he charged his
adversary with having misused his po-
sitlon in the Reichstag to utter what
' he knew to be baseless calumnies, and
with being no longer worthy to occupy
the position of Judge.
Herr Roeren's answer to this was to
.enter an action of libel, the hearing
of which has Just concluded. Judg
ment has been reserved, but the evl
idence given has already" raised the
proceedings to the first rank among
political causes celebres. for not only
has It produced a number of extra
ordinary vignettes of German Colonial
life, but It has aroused something
more than a "strong suspicion that
Herr Dernburg's specific indictment
anrl the wild attack on the Center
which followed it were. under the
mildest interpretation, based on misap
prehension. The witnesses examined were chief
ly German Colonial officers, who were
nearly all on the side of Schmidt, and
the Fathers of the Catholic Mission
at Atakpame, who were unanimous
against him. The evidence showed that
Schmidt had at least three black
wives, and one witness deposed that
everywhere he went he met black
women who 'claimed to be wives of
Schmidt. Schmidt admitted that he
maintained a harem, but he said It
was the custom of the country, and
all of the German officials and officers
had black wives; in fact, there were
no other women in the colony.

Montclalr Health Board Declares

MONTCLA1R, N. J., Oct. 15. The
most important forward move yet un
dertaken by any municipality In this
country has been made by the Board
of Health of this town In ordering the
exclusion of all milk that comes from
herds that are not proved free from
tuberculosis.
This action is based upon the dem
onstrations of Dr. E. C. Schroeder and
lr. John V. Mnhler, of the Bureau of

partment of Agriculture. These ex

lveness of milk from tuberculous ?ows
and the probability of all milk from
untested herds containing the germs
that convey consumption to men, wom
en and children.
Acting upon these proofs " of the
common cause of tuberculosis, the Fed
eral Government has urgently recom
mended the pasteurization of all milk
from untested herds.
Six months ago the Montclalr Health
Board warned a big company that has
been bitterly opposing pasteurization
that If It wished to continue to sell Its
milk raw It would have to certify that
the cows supplying the milk had been
tested with tuberculin and proved free
from the disease.
The certificates offered have been
unsatisfactory, superficial examina
tions being relied upon In many cases

The action of the health board has
been precipitated by the declared In
tention of the milk; trust to fight both
pasteurization and the enforced test
ing of cows with tuberculin.
The urgency of the peril of tuber
culous milk was demonstrated last
week by the discovery that there were
32 tuberculous cows in the model, cer
tified herd kept by the City of New
York on Randall's Island to supply
milk for the city's waifs. This discov
ery led the city's charities commis
sioner, Hebberd, to substitute ' for the
certified milk of this herd pasteurized
milk, which has been used at all the
other city institutions.
