This Name Worth $100 Avers Nick Costa. lie Brings Suit, All-rinr That Rival' Appropriated Title, American It nllan Grocery," (rtVfHATS lnanamer Nick Costa, W a First-street groceryman In a complaint filed in the Circuit Court yesterday tells Francesco Aceto, a mer chant on the same thoroughfare, a cognomen is worth $100 and costs. The name thus valued by Costa Is "American-Italian Grocery," which hangs in a multicolored sign over bis place of business at 342 First stret. That Aceto maliciously usurped this name and ap plied it to his rival grocery store sit uated across the street. Is the com plaint of Costa, who alleges the usur pation has damaged him 'to the extent of $100. Costa asserts he was given exclusive use of the title "American-Italian Gro cery" by the Secretary of State May 27, and that his rival, Francesco, know ing he had obtained the privilege, called his store the "New American Italian Grocery," and published this fact to the consumers of the neighbor hood by erecting a sign bearing the words. Costa also accuses Aceto of calling his store "The American & Italian Grocery" for. the purpose of deceiv ing patrons who have heretofore fol lowed Costa's sign as they would a finger post.
