tered "drug trust," beginning proceedings
In Indiana on the (round of a combi
nation to fix prices to the consumer. Attorney-General
Moody makes publlo this
statement: .
"The Government today filed in the Cir
cuit Court of the United States for the
District of Indiana petition for an injunc
tion against certain associations, .corpora
tions and Individuals,' comprising; what is
commonly known as the 'drug trust of the
United States.'
"The parties defendant specifically
named m the bill have voluntarily com
bined together to control tbe prloes at
which proprietary medicines and drugs
shall be sold to the consumer through the
retail druggists in violation of the Sher
man anti-trust law.
"Tbe parties to the combination Include
the Proprietary Association of America
and tbe National Association of Retail
Druggists."
Who Defendant Are.
The Proprietary Association of Araer
oa la an unincorporated association of

proprietaries of patent medicines, drugs
and proprietary articles in the United
States. :
"The National Wholesale Zrngg1sts As
sociation is also an unincorporated asso
ciation composed of Dearly all. the whole
sale druggists in the United States. These
wholesale druggists act as tbe dis
tributing agents for the - manufacturers
and proprietaries of patent medicines,
chemicals, drugs and proprietary articles,
purchasing the same direct from the
manufacturers, and supplylnr the same
to the retail druggists In - various parts
of the country.
"The National Association of Retail
Druggists is also an unincorporated as
sociation, composed of delegates from af
filiated local associations of retail drug
gists located in the various states of the
United States, and It W claimed that
this association, through Its affiliations,
baa a membership of aboat' 10.000, or
nearly all tbe retail druggists in tbe
United States who purchase and sell pat
ent medicines, ohemicala, drugs and pro
prietary articles to the consumer.
"Each of these three associations has
officers who. are made party defendants,
as well as certain other individuals, firms
and corporations who are members of
the respective association.
"There Is but one ultimate object of
the conspiracy, vis.: To fix tbe price
which shall be observed by all retail
druggists In selhng to tbe consumer the
various commodities manufactured by the
several members of the proprietary asso
ciation. How Price Are Herniated.
'"The plan by which such object la ef
fected Is in brief as follows: No retail
druggist can obtain goods from a whole
sale druggist or - a manufacturer of - g
proprietary medicine unless fueh retail
druggist becomes a member of the Na
tional Association of Retail . Druggists,
and la order to booone such member, he
must agree to observe tbe established
price at which such proprietary medicines
shall be sold to the consumer."
An Injunction is prayed for prohibiting
these associations from acting In con
cert for the purpose of maintaining
prices, and the Individuals, firms and
corporations who are members of the
respective associations from acting . to
gether for the purpose of maintaining
uniform prices to the oonsumers through
