The petition for rehearing sets out cer tain sworn allegations and admissions made by The Title Guarantee & Trust Co. in its pleadings in the suit brought to foreclose the mortgage on Judge Mar quam's property, and shows' that these admissions and allegations of The Title Guarantee & Trust Co. are inconsistent with the position assumed by that com pany in the present suit.
