A.M. Pacific Time, Friday. January 10,2003 A four hour period shall
follow in w hich all bidders shall subm it to the City of Garibaldi a
S u b c o n tra c to r D is c lo s u re F o rm , id e n tify in g a n y fir s t-tie r
subcontractor th a t will be furnish ing labor and m aterials on the
Contract. Refer to D isclosure Form and Instructions to Bidders
within the Contract Documents. The bid opening shall be conducted
in the G aribaldi City hall. Sealed bids will be publicly opened and
read aloud at 3:00 P.M. Pacific Time, Friday, January 10,2003. Bids
submitted prior to opening are to be delivered to: City Administrator,
Mr. Joe Wrabek, 107 6<h Street (P.O. Box 708), Garibaldi, OR 97118.
The project consists of an expansion of the sew age treatm ent
plant, pum p stations, and associated sitework, structural, piping,
and electrical work.

Rental Rates start at $367.00 per month and will not exceed $752.00 per
month. Rates are based on 30% of the total household Income.
If subsidized units are not available at this time, qualified applicants will
be placed on a waiting list.
Successful Bidders m ust be registered, or shall become registered,
with the Construction C o n tra ctor’s Board as required by ORS
671.530 if awarded a contract. Bidder is not required to be licensed
under ORS 468A.720. Each bid m ust contain a statem ent as to
w h eth e r th e B idder is a R e side nt B idder as defined in ORS
279.029.
No bid will be considered unless fully com pleted in th e m anner
provided in the "Instruction s to B idders”, upon the Bid Form
(Proposal) provided by the Engineer, and accompanied by a certified
check or Bid Bond executed in fa v o ro fth e C ity of Garibaldi in an
am ount not less than ten percent (10%) of the total am ount of the
bid. Bid Bond is to be forfeited as a fixed and liquidated dam age
should the successful Bidder neglect or refuse to enter into a
c o n tra c t and p ro vid e s u ita b le bonds to en su re th e fa ith fu l
perform ance and paym ent of the work (in the event the contract
is awarded such Bidder). Funds for the improvements are available,
and m onthly paym ents will be m ade by check.
C o n tra cts a w a rde d under th is N otice to Co ntra ctors w ill be
financed with a grant from the United States and the Departm ent
of housing and Urban D evelopm ent (HUD) through the Oregon
C o m m u n ity D e v e lo p m e n t B lo c k G ra n t P ro g ra m (O C D ),
adm inistered by the Econom ic D evelopm ent D epartm ent (ED D )
of the State of O regon and by a grant and loan from the U.S.
Departm ent of Agriculture, Rural Development. Neither the United
States nor any of its departm ents, agencies, or em ployees is or
will be a party to this Notice to contractors of any resulting contract.
This procurem ent will be subject to regulations contained in Part
33 Procurem ent Under Assistance Agreem ents. Contracts are
subject to 40 CFR regulations.
Bidders on this work will be required to com ply with the provisions
of the President’s Executive Order No. 11246 co ncerning equal
e m p lo y m e n t o p p o rtu n ity , in c lu d in g a ll a m e n d m e n ts a n d
requirem ents issued thereunder. The requirem ents for Bidders
and Contractors under this O rder are explained in the Contract
Documents.
The attention o f Bidders is directed to the requirem ents and
conditions o f em ploym ent to be observed and m inim um rates to
be paid under the Contract. The Bidder shall comply with provisions
of the Davis-Bacon Act (40 U.S.C. 276a) for this public work project.
Before a Contract will be awarded, com pliance with all HUD, EDD
and Rural D evelopm ent requirem ents specified in the Contract
Docum ents will be subject to HUD, EDD and Rural D evelopm ent
review and approval.
The City of Garibaldi may reject any bid not in com pliance with all
prescribed bidding procedures and requirem ents, and may reject
for good cause any and all bids upon finding of the City of Garibaldi
th a t it is in the public interest to do so.
No Bidder m ay w ithdraw or m odify its bid after the hour set for the
opening, and thereafter until the lapse o f ninety (90) calendar
days from th e bid opening date.
