Voters in New Mexico will decide in Novem­
ber whether to remove an “alien land statute"
from the state constitution that bars Asian
immigrants from owning property. Last May,
Kansas repealed a similar unenforced law. The
Wyoming L.egislature last year repealed its
1943 alien land law, enacted during World War
II to keep Japanese from buying property.
Voters in South Carolina and Alabama ex­
punged interracial marriage bans from their
constitutions in 1998 and 2000, respectively.
Encouraged by the actions o f South Caro­
lina and Alabama, Jack Chin, a professor at the
University o f Cincinnati College o f Law, is
leading a nationwide project to inform states of
anachronistic language in their constitutions,
and to encourage them to remove it.
“Some say it’s good to keep statues and
buildings named after people like Jeffrey
Amherst, w ho did much to settle the colonies
but also gave smallpox blankets to Indians,”
Chin said. "But the constitution is not sym ­
bolic. It is a living law.”
“ I think this is a very good exercise,” said
Chet Orloff, director emeritus o f the Oregon
Historical Society. "It reminds us what kinds o f
people were here in the 1850s and reminds us
o f the vigilance and care one has to take in
crafting the constitution.”
