C ity bom bing, recalling the h o n o r o f the w orst
terrorist attack on U.S. soil and the heroism that
rose from the rubble. T he m em orial is near the

federal building inApril 1995,killing 168 people,
19 o f them children. Congress approved $5
m illion to create the m useum . It w ill be m ain­
tained through endow m ents,m em bership dues

T he state governm ent said m ost hostages and

stayed voluntarily — had been released and
that all but tw o prisons in the state’s interior had
been brought back under control.

led to a search w arran t for D an n y L ee K y llo ’s
h o m e in F lorence, O re. Inside, agents found
d ru g p arap h ern alia an d m o re th an 100 m ari­

T h e governm ent argues feat law enforce­
m ent officials w ere w ithin constitutional lim ita­
tions w hen they utilized the scan, w hich sensed
heat patterns em an atin g from K y llo ’s hom e
indicative o f lights u sed to grow m arijuana.
T h ey used fee im ages — along w ith a tip from
an inform ant and electricity records — to ob­
tain a search w arrant. In court papers, govern­
m ent law yers co m p ared fee therm al im aging
scan to an officer o bserving so m eo n e’s home.
T h ey argued feat fee scan does not penetrate
fee ho u se and reveal p riv ate activities, and is
not a constitutional violation.
T h e “governm ent investigator stationed in
a public place used a th erm al im ager to observe
an a rea exposed to the public — fee ro o f and
exterior w alls o f a h o u se— an d d id not observe
private activities,” they w rote.
In 1991, a narcotics task force w as investi­
gating w hether K y llo ’s neighbors w ere g ro w ­
ing m arijuana a t a triplex house.
B ut w hen officers used a therm al im ager on
K y llo ’s residence, they found unusual am ounts
o f heat com ing from his h o m e ’s side w all and
garage roof. A fter obtaining a w arrant and
searching fee house in January 1992, K yllo w as
arrested. H e faces only a m o n th in ja il for
producing m arijuana if fee S uprem e C ourt rules
against him . B u t fee decision could lead to
im portant new guidelines on how law enforce­
m ent officials u se technology w hile conduct­
ing searches.
