Smith DOB 7-24-28 of 932 N Alberta Street in connection with the sexual abuse of three young girls. Smith, who is Pastor oftheFirst A.N.E. ZionChurchat 109 N Skidmore Street, was arrested at 11:00 am. Thursday, March 11. 1993 after surrendering to Detective Mitch Copp at the Detective Division Detectives believe that from Septem ber 1990 through January 1993, Smith has engaged in a pattern of sexually fondling the victims, all of whom attended his church. The in­ vestigation was initiated in February 1993 when a teacher contacted Port­ land Public School Police to investi­ gate a com plaint of inappropriate touching. The 13 year old victim told the officer that Smith had cornered her in a office and began fondling her. Detectives later learned of a sec­ ond victim, who reported that from September 1990 through January 1992, Smith had repeatedly sexually- abused her. The victim who is 14 years old, was 12-13 years at the time of the alleged incidents Athird victim was identified based upon the earlier interviews. This vic­ tim is presently 22 years old and re­ ported that at the age of 17-18 years of age. Smith cornered her in a church office and fondled her. Smith turned himself in after be­ ing contacted by Detectives. Smith was charged with 11 counts of Sexual Abuse in the First Degree and one count of Sexual Abuse in the Third Degree. Smith was lodged at the Justice Center in lieu of $225,000 bail with arraignment scheduled for 2:00 pm Friday, March 12, 1993 at the Justice Center. Under Oregon law sexual abuse in the first degree occurs when 1) a person subjects another person to sexual contact and, a) the victim is less than 14 years of age; b) or the victim is subjected to forcible compul­ sion by the suspect A person commits sexual abuse in the third degree if the victim does not consent or is incapable of consent by reason o f being under 18 years of age or is mentally incapable. Sexual abuse in the first degree is a class B felony, while sexual abuse in the third degree is a class A misde­ meanor.
